2025-S8469 (ACTIVE) - Summary
Provides that a licensee for an adult-use retail dispensary whose license was approved by the office prior to July twenty-eighth, two thousand twenty-five, and whose business location was found to be in compliance with standards used by the office at the time of such approval, regardless of such business location's proximity to a school property line, shall be deemed compliant for purposes of license renewal and continued operation at such location.

BILL NUMBER: S8469 SPONSOR: SEPULVEDA TITLE OF BILL: An act to amend the cannabis law, in relation to the proximity of an adult-use retail dispensary licensee's business location to a school PURPOSE: To allow existing adult-use cannabis retail dispensary licensees, who were approved under prior guidance from the Office of Cannabis Manage- ment (OCM), to remain at their current business locations-even if those locations are later determined to be within 500 feet of a school proper- ty line, provided the licensee was in good standing and operating in reliance on OCM's previous location assessments. SUMMARY OF PROVISIONS: Section 1: Amends Cannabis Law Section 72 by adding new subdivision 7, which grandfathers in any licenses that were approved in error by the Office of Cannabis Management prior to July 28, 2025.

SEPULVEDA -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the cannabis law, in relation to the proximity of an adult-use retail dispensary licensee's business location to a school THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 72 of the cannabis law is amended by adding a new subdivision 7 to read as follows: 7. NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION SIX OF THIS SECTION OR ANY OTHER LAW TO THE CONTRARY, ANY LICENSEE FOR AN ADULT-USE RETAIL DISPENSARY WHOSE INITIAL LICENSE WAS APPROVED BY THE OFFICE PRIOR TO JULY TWENTY-EIGHTH, TWO THOUSAND TWENTY-FIVE, AND WHOSE BUSINESS LOCATION WAS FOUND AT THE TIME OF SUCH APPROVAL TO BE IN COMPLIANCE WITH STANDARDS USED BY THE OFFICE AT SUCH TIME, REGARDLESS OF SUCH BUSINESS LOCATION'S ACTUAL PROXIMITY TO A SCHOOL PROPERTY LINE, SHALL BE DEEMED COMPLIANT FOR THE PURPOSES OF LICENSE RENEWAL AND CONTINUED OPERATION AT SUCH LOCATION, PROVIDED THAT: (A) SUCH LICENSEE HAS NOT OTHERWISE VIOLATED ANY PROVISION OF THIS CHAPTER OR APPLICABLE REGULATIONS; AND (B) SUCH LICENSEE REMAINS IN GOOD STANDING WITH THE OFFICE. § 2. Hello senator, as. Bronx resident of 15 years I have seen the devastating affects of cannabis shops located in close proximity of schools. I do not find it fit, that any such establishment could be deemed an appropriate business near any school. We must start prioritizing education over drugs.
