 Introduced  by Sen. BORRELLO -- read twice and ordered printed, and when
   printed to be committed to the Committee on Rules
 
 AN ACT to amend the vehicle and traffic  law,  in  relation  to  certain
   motor  vehicle  documents and plates; and to repeal certain provisions
   of such law relating thereto

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  392-a of the vehicle and traffic law is REPEALED
 and a new section 392-a is added to read as follows:
   § 392-A. FRAUDULENT MOTOR VEHICLE DOCUMENTS AND PLATES.   1. A  PERSON
 WHO  KNOWINGLY  SELLS,  OFFERS  TO SELL, BUYS, OR OFFERS TO BUY A FALSE,
 FRAUDULENT, OR  STOLEN  LICENSE,  IDENTIFICATION  CARD,  CERTIFICATE  OF
 REGISTRATION, OR NUMBER PLATE SHALL BE GUILTY OF:
   (A)  FIRST  OFFENSE: A CLASS E FELONY, PUNISHABLE BY UP TO ONE YEAR OF
 IMPRISONMENT AND A FINE OF NO LESS THAN FIVE HUNDRED DOLLARS; AND
   (B) SECOND OFFENSE WITHIN TEN YEARS: A CLASS D FELONY,  PUNISHABLE  BY
 ONE  TO THREE YEARS OF IMPRISONMENT, A FINE OF NO LESS THAN ONE THOUSAND
 DOLLARS, AND A SUSPENSION OF THE OFFENDER'S DRIVER'S LICENSE FOR A PERI-
 OD OF NO LESS THAN ONE YEAR.
   2. ANY PERSON WHOSE DRIVER'S LICENSE OR REGISTRATION IS  SUSPENDED  OR
 REVOKED AND WHO KNOWINGLY USES, DISPLAYS, OR PERMITS THE USE OF A FALSE,
 FRAUDULENT,  OR STOLEN NUMBER PLATE SHALL BE GUILTY OF A CLASS D FELONY,
 PUNISHABLE BY:
   (A) ONE TO THREE YEARS OF IMPRISONMENT;
   (B) A FINE OF NO LESS THAN ONE THOUSAND FIVE HUNDRED DOLLARS; AND
   (C) AN AUTOMATIC EXTENSION OF THE SUSPENSION PERIOD FOR AN  ADDITIONAL
 TWO TO FOUR YEARS.
   §  2.  Subdivision  1 of section 402 of the vehicle and traffic law is
 amended by adding a new paragraph (c) to read as follows:
   (C) A SECOND CONVICTION FOR VIOLATING PARAGRAPH (II), (II-A), OR (III)
 OF PARAGRAPH (B) OF THIS SUBDIVISION, COMMITTED WITHIN TEN  YEARS  OF  A
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.
