CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY
proposing an amendment to article 1 of the constitution, in relation to
adding a right to privacy
Section 1. Resolved (if the Assembly concur), That article 1 of the
constitution be amended by adding a new section 20 to read as follows:
§ 20. THE RIGHT OF THE PEOPLE TO PRIVACY IS RECOGNIZED AND SHALL NOT
BE INFRINGED. IN APPLYING THIS SECTION, A COURT SHALL CONSIDER THE
NATURE AND EXTENT OF THE INFORMATION WHICH MAY BE OBTAINED, IF ANY, AND
THE NATURE AND EXTENT OF THE INTRUSION.
§ 2. Resolved (if the Assembly concur), That the foregoing amendment
be referred to the first regular legislative session convening after the
next succeeding general election of members of the assembly, and, in
conformity with section 1 of article 19 of the constitution, be
published for 3 months previous to the time of such election.
