 Introduced by Sen. SEPULVEDA -- read twice and ordered printed, and when
   printed to be committed to the Committee on Consumer Protection
 
 AN  ACT  to amend the general business law, in relation to penalties for
   failure of an operator to return shared electric scooters and bicycles
   to a proper location
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The general business law is amended by adding a new section
 390-f to read as follows:
   §  390-F.  SHARED  ELECTRIC BIKE AND  ELECTRIC SCOOTER SYSTEMS; PENAL-
 TIES.  ANY SHARED BICYCLE WITH ELECTRIC ASSIST SYSTEM AND  SHARED  ELEC-
 TRIC   SCOOTER   SYSTEM,   AS   DEFINED   IN  ARTICLES  THIRTY-FOUR  AND
 THIRTY-FOUR-D OF THE VEHICLE AND TRAFFIC  LAW,  RESPECTIVELY,  OPERATING
 WITHIN THIS STATE SHALL IMPOSE MONETARY PENALTIES ON ANY USER OR BORROW-
 ER  WHO  FAILS TO RETURN A SHARED BICYCLE WITH ELECTRIC ASSIST OR SHARED
 ELECTRIC SCOOTER TO  A  PROPER  LOCATION  AS  SPECIFIED,  DESIGNATED  OR
 DIRECTED  BY  THE  SYSTEM. SUCH PENALTY SHALL BE IMPOSED DAILY UNTIL THE
 DEVICE IS RETURNED TO THE PROPER LOCATION.
   § 2. This act shall take effect on the thirtieth day  after  it  shall
 have become a law.
