TITLE OF BILL:

An act to amend the racing, pari-mutuel wagering and breeding law, in
relation to requiring mobile sports wagering operators to establish
default betting limits on their platforms and to notify authorized
sports bettors of their ability to opt-out of the default betting limits

 
PURPOSE:

To create a default safety mechanism for users of mobile betting plat-
forms that limits the amount that a user can bet in a given period of
time, while allowing for the personal freedom to remove the default
limits.

 
SUMMARY OF PROVISIONS:

Section one: Short title

Section two: Creates a new subdivision 4-a of section 1367-a of the

racing, pari-mutuel wagering and breeding law to mandate a default
setting on mobile betting applications to limit the amount a user can
wager in a given period, to be determined by the gaming commission.

Section three: Establishes the effective date.

 
JUSTIFICATION:

This legislation is an important step in mitigating the widespread and
damaging effects of gambling addiction, which has become increasingly
prevalent in New York. By establishing a default limit on gambling apps,
we can create a safety mechanism that helps protect users from the
potentially devastating financial consequences of excessive betting.

Research indicates that individuals are far more likely to gamble
responsibly when they are automatically enrolled in a betting limit, as
opposed to simply being offered the option to opt-in. A recent Australi-
an study found that opt-out default betting limits led to an increase of
3,500% in a gambler's likelihood to use that limit. An opt-in model, the
study found, did not work at all. This proactive approach not only
encourages responsible gambling behaviors but also significantly reduces
the risk of addiction.

Furthermore, the rise of mobile gambling apps has made it easier than
ever for individuals to engage in risky betting behavior, often leading
to severe personal and financial crises. By implementing a default
limit, we can effectively curb these negative outcomes while still
respecting personal freedom. Users will retain the ability to opt-out of
these limits, thus empowering them to make informed choices about their
gambling activities.

 AN  ACT  to  amend the racing, pari-mutuel wagering and breeding law, in
   relation to requiring mobile sports wagering  operators  to  establish
   default  betting  limits  on  their platforms and to notify authorized
   sports bettors of their ability to  opt-out  of  the  default  betting
   limits
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Short title. This act shall be known and may  be  cited  as
 the "choice in responsible gaming act".
   §  2.  Section 1367-a of the racing, pari-mutuel wagering and breeding
 law is amended by adding a new subdivision 4-a to read as follows:
   4-A. (A) FOR THE PURPOSES OF THIS SUBDIVISION, "DEFAULT BETTING LIMIT"
 SHALL MEAN A DEFINED, MAXIMUM MONETARY AMOUNT THAT AN AUTHORIZED  SPORTS
 BETTOR  MAY  WAGER  THROUGH  A  MOBILE  SPORTS  WAGERING PLATFORM OVER A
 DEFINED PERIOD OF TIME.
   (B) ALL MOBILE  SPORTS  WAGERING  OPERATORS  SHALL  IMPLEMENT  DEFAULT
 BETTING  LIMITS  ON  THEIR MOBILE SPORTS WAGERING PLATFORMS. THE DEFAULT
 BETTING LIMIT SHALL BE DETERMINED BY THE COMMISSION PRIOR TO THE  EFFEC-
 TIVE  DATE  OF THIS SUBDIVISION AND SHALL BE BASED ON THE BEST PRACTICES
 TO ENCOURAGE RESPONSIBLE GAMBLING.
   (C) WHEN AN AUTHORIZED SPORTS BETTOR REGISTERS  FOR  A  MOBILE  SPORTS
 WAGERING  OPERATOR'S  PLATFORM,  SUCH  AUTHORIZED SPORTS BETTOR SHALL BE
 OPTED-IN TO THE DEFAULT BETTING LIMIT. AUTHORIZED SPORTS BETTORS WHO ARE
 ALREADY REGISTERED FOR THE MOBILE SPORTS WAGERING PLATFORM PRIOR TO  THE
 EFFECTIVE DATE OF THIS SUBDIVISION SHALL ALSO BE OPTED-IN TO THE DEFAULT
 BETTING  LIMIT.  ALL  AUTHORIZED SPORTS BETTORS SHALL HAVE THE OPTION TO
 OPT-OUT OF THE DEFAULT BETTING LIMIT.
   (D) THE MOBILE SPORTS  WAGERING  OPERATOR  OR  PLATFORM  SHALL  NOTIFY
 AUTHORIZED  SPORTS BETTORS OF THE EXISTENCE OF THE DEFAULT BETTING LIMIT
 AND THE OPTION TO OPT-OUT AT THE TIME OF  REGISTRATION.  FOR  AUTHORIZED
 SPORTS  BETTORS  ALREADY REGISTERED FOR THE MOBILE SPORTS WAGERING PLAT-
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

 FORM PRIOR TO THE EFFECTIVE DATE OF THIS  SUBDIVISION,  SUCH  AUTHORIZED
 SPORTS  BETTORS  SHALL  BE  NOTIFIED THAT THEY HAVE BEEN OPTED-IN TO THE
 DEFAULT BETTING LIMIT AND THAT THEY HAVE THE OPTION TO OPT-OUT.
   § 3. This act shall take effect on the one hundred eightieth day after
 it shall have become a law.  Effective immediately, the addition, amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation  of  this act on its effective date are authorized to be made and
 completed on or before such effective date.
