 AN ACT to amend the public authorities law,  in  relation  to  expanding
   time-delay mechanisms on emergency exit gates
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The public authorities law  is  amended  by  adding  a  new
 section 1279-j to read as follows:
   §  1279-J.  TIME-DELAY  EMERGENCY  MECHANISMS.  1. THE AUTHORITY SHALL
 INSTALL AND REASONABLY MAINTAIN  TIME-DELAY  EGRESS  MECHANISMS  ON  ALL
 EMERGENCY  GATES  AT  ALL  SUBWAY  STATIONS  OPERATED  BY THE AUTHORITY.
 FURTHER, THE AUTHORITY WHEN INSTALLING SUCH TIME-DELAY EGRESS  MECHANISM
 SHALL:
   (A) INCLUDE OVERRIDE SYSTEMS IN THE EVENT OF EMERGENCIES (E.G., FIRES,
 POWER FAILURES, EMERGENCY EVACUATIONS); AND
   (B) COMPLY WITH THE AMERICANS WITH DISABILITIES ACT OF 1990.
   2. THE AUTHORITY SHALL BE PROHIBITED FROM USING SUCH TIME-DELAY EGRESS
 MECHANISMS   AT  UNSTAFFED  STATIONS.  FURTHER,  IF  A  STATION  BECOMES
 UNSTAFFED, THE AUTHORITY SHALL BE REQUIRED TO DEACTIVATE SUCH TIME-DELAY
 MECHANISM UNTIL SUCH STATION HAS A TRAINED  HUMAN  STATION  AGENT  PHYS-
 ICALLY PRESENT AND ON DUTY.
   § 2. This act shall take effect immediately.

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public authorities law  is  amended  by  adding  a  new
 section 1279-j to read as follows:
   §  1279-J. TIME-DELAY EMERGENCY MECHANISMS.  NOTWITHSTANDING ANY OTHER
 PROVISION OF LAW, THE  AUTHORITY  MAY  INSTALL  AND  OPERATE  TIME-DELAY
 EGRESS MECHANISMS ON EMERGENCY EXIT GATES AT SUBWAY STATIONS OPERATED BY
 THE  AUTHORITY.  THE AUTHORITY SHALL BE PROHIBITED FROM USING SUCH TIME-
 DELAY EGRESS MECHANISMS AT UNSTAFFED  STATIONS.  IF  A  STATION  BECOMES
 UNSTAFFED, THE AUTHORITY SHALL BE REQUIRED TO DEACTIVATE SUCH TIME-DELAY
 MECHANISM  UNTIL  SUCH  STATION  HAS A TRAINED HUMAN STATION AGENT PHYS-
 ICALLY PRESENT AND ON DUTY.   FURTHER, ANY TIME-DELAY  EGRESS  MECHANISM
 UTILIZED PURSUANT TO THIS SECTION SHALL:

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  public  authorities  law  is amended by adding a new
 section 1279-j to read as follows:
   § 1279-J. TIME-DELAY EMERGENCY MECHANISMS. 1. THE AUTHORITY MAY  OPER-
 ATE  TIME-DELAY  EGRESS  MECHANISMS  ON  EMERGENCY  EXIT GATES AT SUBWAY
 STATIONS OPERATED BY THE AUTHORITY; PROVIDED, HOWEVER, THAT  SUCH  MECH-
 ANISMS SHALL ONLY BE UTILIZED AT STATIONS WHERE PERSONNEL ARE PHYSICALLY
 PRESENT  AND  AVAILABLE TO RESPOND TO EMERGENCIES OR OPERATIONAL ISSUES,
 OR DURING A TEMPORARY INTERRUPTION AS SET FORTH IN  SUBDIVISION  TWO  OF
 THIS SECTION.
   2.  IN THE EVENT PERSONNEL BECOME TEMPORARILY UNAVAILABLE DUE TO SHIFT
 CHANGES, BREAKS, OR OTHER TEMPORARY  INTERRUPTIONS,  THE  AUTHORITY  MAY
 CONTINUE  OPERATION  OF ANY TIME-DELAY EGRESS MECHANISM FOR A PERIOD NOT
 TO EXCEED TWO HOURS. UPON EXPIRATION OF SUCH PERIOD, THE AUTHORITY SHALL
 DEACTIVATE ANY SUCH MECHANISM UNTIL PERSONNEL ARE PHYSICALLY PRESENT AND
 AVAILABLE TO RESPOND TO EMERGENCIES OR OPERATIONAL ISSUES.
   3. NOTHING IN THIS SECTION SHALL BE CONSTRUED TO REQUIRE THE AUTHORITY
 TO STAFF ANY STATION. HOWEVER, WHERE THE AUTHORITY ELECTS NOT TO PROVIDE
 PERSONNEL AT A STATION, ANY TIME-DELAY EGRESS MECHANISM SUBJECT TO  THIS
 SECTION SHALL BE DEACTIVATED.
   4.  THIS  SECTION  SHALL  APPLY ONLY TO EMERGENCY EXIT GATES UTILIZING
 TIME-DELAY EGRESS MECHANISMS AND MAY NOT APPLY TO FARE CONTROL GATES  OR
 OTHER GATES THAT OPEN UPON PAYMENT OF FARE OR VALID FARE MEDIA.
   5.  NOTHING IN THIS SECTION SHALL BE CONSTRUED TO CONFLICT WITH APPLI-
 CABLE FEDERAL, STATE, OR LOCAL BUILDING CODE, FIRE SAFETY,  OR  ACCESSI-
 BILITY REQUIREMENTS.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law.
