TITLE OF BILL:

An act to amend the alcoholic beverage control law, in relation to
increasing the number of package store licenses able to be held by one
person

 
PURPOSE:

This bill will allow retail liquor store license holders to hold a
second license, and to reciprocally purchase products from other license
holders.

 
SUMMARY OF PROVISIONS:

Section 1: Amends subdivision 5 of section 63 control law to allow for
the provision of two section.of the alcoholic beverage licenses per
person under this

Section 2: Amends subdivision 2 of section 79 control law to allow for

the provision of two section.of the alcoholic beverage licenses per
person under this

Section 3: Adds a new subdivision 2-a to section 105 of the alcoholic
beverage control law that provides for reciprocal purchasing and selling
of license holders under section 63 and section 79, and dictates
record-keeping requirements.

Section 4: Sets the effective date.

 
JUSTIFICATION:

Package store licensees in New York State are currently prohibited from
acquiring more than one license in their name. Yet, some liquor store
owners skirt this law by engaging their spouse or a family member to
apply for a new license. Tracking of these family licensing networks,
and enforcement of the single license statute, is difficult and costly
for the SLA.

At the same time, stakeholders within and outside of the industry are
concerned that lifting the license cap altogether would encourage mono-
polization by large liquor stores and drive mom and pop owners out of
business.

In the interest of facilitating healthy market competition and small
business growth, this bill would lift the cap on package store licenses
from one to two per person. It would also allow these license holders to
purchase from and sell to other license holders, providing flexibility
and bulk discount opportunities for these businesses outside of whole-
sale agreements.

 AN  ACT  to  amend  the  alcoholic  beverage control law, in relation to
   increasing the number of package store licenses able to be held by one
   person

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  5  of  section  63 of the alcoholic beverage
 control law is amended to read as follows:
   5. Not more than [one license] TWO LICENSES shall be  granted  to  any
 person under this section.
   § 2. Subdivision 2 of section 79 of the alcoholic beverage control law
 is amended to read as follows:
   2.  Not  more  than [one license] TWO LICENSES shall be granted to any
 person under this section.
   § 3. Section 105 of the alcoholic  beverage  control law is amended by
 adding a new subdivision 2-a to read as follows:
   2-A. (A) NOTWITHSTANDING ANY PROVISION OF THIS CHAPTER TO THE  CONTRA-
 RY:
   (I)  A LICENSEE ISSUED UNDER SECTION SIXTY-THREE OF THIS CHAPTER SHALL
 BE AUTHORIZED TO PURCHASE WINE OR LIQUOR  FROM,  AND  TO  SELL  WINE  OR
 LIQUOR  TO,  ANY OTHER LICENSEE ISSUED UNDER SECTION SIXTY-THREE OF THIS
 CHAPTER, AND MAY RESELL ANY WINE OR LIQUOR SO PURCHASED FOR  CONSUMPTION
 OFF THE PREMISES.
   (II) A LICENSEE ISSUED UNDER SECTION SIXTY-THREE OF THIS CHAPTER SHALL
 BE  AUTHORIZED  TO  PURCHASE  WINE FROM, AND TO SELL WINE TO, A LICENSEE
 ISSUED UNDER SECTION SEVENTY-NINE OF THIS CHAPTER, AND  MAY  RESELL  ANY
 WINE SO PURCHASED FOR CONSUMPTION OFF THE PREMISES.
   (III)  A  LICENSEE  ISSUED  UNDER SECTION SEVENTY-NINE OF THIS CHAPTER
 SHALL BE AUTHORIZED TO PURCHASE WINE FROM, AND SELL WINE TO,  ANY  OTHER
 LICENSEE  ISSUED  UNDER  SECTION  SEVENTY-NINE OR SECTION SIXTY-THREE OF
 THIS CHAPTER, AND MAY RESELL ANY WINE SO PURCHASED FOR  CONSUMPTION  OFF
 THE PREMISES.
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

   (B)  BOTH  THE SELLING AND PURCHASING LICENSEES SHALL RETAIN A RECEIPT
 OR INVOICE FOR  EACH  TRANSACTION  AUTHORIZED  BY  THIS  SUBDIVISION  IN
 ACCORDANCE  WITH THE STATE LIQUOR AUTHORITY'S EXISTING BOOKS AND RECORDS
 REQUIREMENTS AND SUCH RECORDS SHALL BE MADE AVAILABLE FOR INSPECTION  BY
 THE  STATE LIQUOR AUTHORITY AND ITS DULY AUTHORIZED AGENTS UPON REQUEST.
 THE RECEIPT OR INVOICE SHALL SHOW, AT A MINIMUM:
   (I) THE NAME, ADDRESS, AND LICENSE NUMBER OF THE SELLER;
   (II) THE NAME, ADDRESS, AND LICENSE NUMBER OF THE PURCHASER;
   (III) THE DATE OF THE TRANSACTION;
   (IV) A DESCRIPTION OF THE ALCOHOLIC BEVERAGES TRANSFERRED  (BRAND  AND
 QUANTITY); AND
   (V) THE PRICE.
   (C)  THE  STATE LIQUOR AUTHORITY   MAY   PROMULGATE  RULES  AND  REGU-
 LATIONS NECESSARY TO IMPLEMENT THE PROVISIONS OF THIS SUBDIVISION.
   § 4. This act shall take effect on the one hundred eightieth day after
 it shall have become a law. Effective immediately, the addition,  amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation  of  this act on its effective date are authorized to be made and
 completed on or before such effective date.
