TITLE OF BILL:

An act to amend the vehicle and traffic law, in relation to requiring
license plates for certain bicycles with electric assist and electric
scooters

 
PURPOSE OR GENERAL IDEA OF BILL:

E-Bikes and E-Scooters that can exceed 28 miles per hour with battery
assistance up to and exceeding 750 watts will be registered and issued a
license plate by the Department of Motor Vehicles.

 
SUMMARY OF PROVISIONS:

Section 1242 of the vehicle and traffic law is amended by adding the new
subdivision 14 a,b,c,d. These additions will require the DMV to issue
license plates to e-bikes that can exceed 28 miles per hour with battery
assistance up to and exceeding 750 watts. These plates will be conspicu-
ously displayed on the rear of the bicycle with electric assist. The fee

for the plates shall be nominal and determined by the commissioner.
Section 1290 will also be added to the vehicle and traffic law which
applies the same requirements in section 1242 to electric scooters.

 
JUSTIFICATION:

Currently, NYS only requires licensing for motor-driven cycles. States
that already require an operator's license for e-bikes include Alabama,
Alaska, Connecticut, Hawaii, Louisiana, Massachusetts, Missouri, and New
Jersey. We know there is an exponential growth in e-bike and e-scooter
traffic across the state.  New York State Police data indicates that
e-bike crashes in 2025 increased 21.5% from the same period in 2024. The
faster battery assisted e-bikes and e-scooters should require licenses.
A licensing requirement would ensure that more operators are educated on
traffic laws, especially regarding the use of bike lanes and road shar-
ing, potentially reducing accidents. This requirement provides a clear
method for police and other authorities to enforce traffic laws and
penalize infractions. Licensing would also help differentiate between
recreational users and those who use e-bikes and scooters for commuting
or commercial purposes.

EFFECTIVE DATE:
This act shall take effect on the ninetieth day after it shall have
become a law. Effective immediately, the addition, amendment and/or
repeal of any rule or regulation necessary for the implementation of
this act on its effective date are authorized to be made and completed
on or before such effective date.

 AN ACT to amend the vehicle and traffic law, in  relation  to  requiring

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section 1242 of the vehicle and traffic law is amended by
 adding a new subdivision 14 to read as follows:
   14. (A) ANY BICYCLE WITH ELECTRIC ASSIST THAT CAN EXCEED  TWENTY-EIGHT
 MILES PER HOUR WITH BATTERY ASSISTANCE UP TO AND EXCEEDING SEVEN HUNDRED
 FIFTY  WATTS  SHALL  BE  REGISTERED  AND  ISSUED  A LICENSE PLATE BY THE
 DEPARTMENT.
   (B) SUCH LICENSE PLATES SHALL BE OF SUCH MATERIAL,  FORM,  DESIGN  AND
 DIMENSIONS  AND CONTAIN OR SET FORTH SUCH DISTINGUISHING NUMBER OR OTHER
 IDENTIFICATION MARKS  AS  THE  COMMISSIONER  SHALL  PRESCRIBE  PROVIDED,
 HOWEVER,  THAT THERE SHALL BE AT ALL TIMES A MARKED CONTRAST BETWEEN THE
 COLOR OF THE NUMBER PLATES AND THAT OF THE NUMERALS OR LETTERS  THEREON,
 AND  PROVIDED FURTHER THAT NO BICYCLE WITH ELECTRIC ASSIST SHALL DISPLAY
 THE NUMBER PLATES OF MORE THAN ONE STATE AT A TIME, NOR SHALL ANY  PLATE
 BE USED OTHER THAN THOSE ISSUED BY THE COMMISSIONER.
   (C)  EACH  SUCH  LICENSE PLATE SHALL BE CONSPICUOUSLY DISPLAYED ON THE
 REAR OF THE BICYCLE WITH ELECTRIC ASSIST.
   (D) THE FEE FOR SUCH LICENSE PLATES SHALL BE A NOMINAL FEE  DETERMINED
 BY THE COMMISSIONER.
   §  2.  The  vehicle and traffic law is amended by adding a new section
 1290 to read as follows:
   § 1290. REGISTRATION OF ELECTRIC SCOOTERS.  1.  ANY  ELECTRIC  SCOOTER
 THAT  CAN  EXCEED TWENTY-EIGHT MILES PER HOUR WITH BATTERY ASSISTANCE UP
 TO AND EXCEEDING SEVEN HUNDRED  FIFTY  WATTS  SHALL  BE  REGISTERED  AND
 ISSUED A LICENSE PLATE BY THE DEPARTMENT.
   2.  SUCH  LICENSE  PLATES  SHALL BE OF SUCH MATERIAL, FORM, DESIGN AND
 DIMENSIONS AND CONTAIN OR SET FORTH SUCH DISTINGUISHING NUMBER OR  OTHER
