 Introduced  by  Sen.  COMRIE -- read twice and ordered printed, and when
   printed to be committed to the Committee on Procurement and Contracts
 
 AN ACT to amend the state finance law, in relation to authorizing  state
   agencies  to  reserve or set aside certain procurements for businesses
   owned by women and minorities
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  4 of section 163 of the state finance law is
 amended by adding a new paragraph h to read as follows:
   H. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, A STATE AGEN-
 CY MAY PROVIDE FOR THE RESERVATION OR SET-ASIDE OF CERTAIN  PROCUREMENTS
 FOR  BUSINESS  ENTERPRISES  DEFINED IN SUBDIVISION SEVEN, FIFTEEN AND/OR
 TWENTY OF SECTION THREE HUNDRED TEN  OF  THE  EXECUTIVE  LAW;  PROVIDED,
 HOWEVER, THAT SUCH PROCUREMENTS SHALL REMAIN SUBJECT TO: (I) PRIORITY OF
 PREFERRED  SOURCES  PURSUANT  TO  THIS  SECTION  AND SECTION ONE HUNDRED
 SIXTY-TWO OF THIS ARTICLE; (II) THE APPROVAL OF THE COMPTROLLER  OF  THE
 STATE  OF  NEW YORK PURSUANT TO SECTION ONE HUNDRED TWELVE OF THIS CHAP-
 TER, AND SECTION  TWENTY-EIGHT  HUNDRED  SEVENTY-NINE-A  OF  THE  PUBLIC
 AUTHORITIES  LAW  AND  THIS  SECTION;  AND  (III) THE PROCUREMENT RECORD
 REQUIREMENTS PURSUANT  TO  PARAGRAPH  G  OF  SUBDIVISION  NINE  OF  THIS
 SECTION.
   §  2.  This act shall take effect immediately; provided, however, that
 the amendments to section 163 of the state finance law made  by  section
 one of this act shall not affect the repeal of such section and shall be
 deemed repealed therewith.
