TITLE OF BILL:

An act to amend the penal law, in relation to companion animals

 
PURPOSE:

To recognize companion animals as sentient beings under New York law and
clarify that they may be considered victims in cases involving animal
cruelty offenses.

 
SUMMARY OF PROVISIONS:

Section 1. Adds new section 243.00 to the penal law to establish that
companion animals, including dogs, cats, and other animals as defined in
section 350 of the Agriculture and Markets law, are sentient beings
capable of experiencing pain, stress, fear, love, and affection.

Section 2. Clarifies that nothing in this act shall reduce or limit any
existing protections afforded to animals under current law.
              

Section 3. Is the effective date.

 
JUSTIFICATION:

Companion animals are sentient beings capable of experiencing pain,
distress, and forming emotional attachment. Recognizing their sentience
within statute reflects both scientific consensus, as well as the reali-
ty that millions of New Yorkers regard their pets as members of their
families.

Current law under Article 26 of the Agriculture and Markets Law provides
protections for animals and establishes criminal penalties for cruelty,
abuse, neglect, and abandonment. However, companion animals are not
always explicitly recognized as victims in criminal proceedings, which
can limit enforcement and the court's ability to fully consider the harm
inflicted.

Scientific research demonstrates that companion animals experience a
range of emotions, including stress, happiness, and social bonding.
Interactions with our pets also benefit humans, such as increasing exer-
cise, reducing stress and loneliness, and improving overall well-being,
and these benefits underscore the importance of recognizing animals as
sentient beings deserving of protection.  Additionally, New York courts
have recognized that animal cruelty statutes are intended to protect
animals from unnecessary pain and suffering and have acknowledged the
unique status of companion animals beyond property. In Deblase v. Hill
(2025), the Kings County Supreme Court allowed a claim for emotional
distress under New York's "zone of danger" doctrine after a woman
witnessed the death of her son's dog struck by a car while she was hold-
ing the leash. In its reasoning, the court acknowledged the growing
understanding that companion animals occupy a special place in families
and society, rather than functioning solely as ordinary property. This
decision reflects a broader trend of courts confronting the evolving
legal status of companion animals and underscores the need for clear
statutory recognition and protection.

This legislation affirms the sentience of companion animals and clari-
fies that they may be treated as victims in cruelty cases. By doing so,
it strengthens enforcement of animal cruelty offenses while aligning New
York law with contemporary scientific understanding and societal stand-
ards regarding animal welfare.

 
EFFECTIVE DATE:
This act shall take effect immediately.
