 Introduced  by Sen. SCARCELLA-SPANTON -- read twice and ordered printed,
   and when printed to be committed to the Committee on Civil Service and
   Pensions
 
 AN ACT to amend the retirement and social security law, in relation to a
   waiver of earnings limitations for  certain  retired  law  enforcement
   officers
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 211 of the retirement and social  security  law  is
 amended by adding a new subdivision 10 to read as follows:
   10.  NOTWITHSTANDING  THE  PROVISIONS  OF  THIS  SECTION, SECTIONS TWO
 HUNDRED TWELVE AND FOUR HUNDRED ONE OF THIS  CHAPTER  AND  SECTION  FIVE
 HUNDRED  THREE OF THE EDUCATION LAW AND ANY OTHER LAW, REGULATION, RULE,
 LOCAL LAW, OR CHARTER TO THE CONTRARY, A RETIRED LAW ENFORCEMENT OFFICER
 MAY BE EMPLOYED AND EARN COMPENSATION IN A POSITION OR POSITIONS IN  THE
 SERVICE  OF THE OFFICE OF THE SPECIAL COMMISSIONER OF INVESTIGATIONS FOR
 THE NEW YORK CITY SCHOOL DISTRICT WITHOUT ANY EFFECT ON THEIR STATUS  AS
 RETIRED  AND WITHOUT SUSPENSION OR DIMINUTION OF THEIR RETIREMENT ALLOW-
 ANCE AND WITHOUT PRIOR APPROVAL PURSUANT  TO  SUBDIVISION  TWO  OF  THIS
 SECTION.  EARNINGS  RECEIVED  AS  A  RESULT  OF  EMPLOYMENT  IN A SCHOOL
 DISTRICT OR A BOARD OF COOPERATIVE EDUCATIONAL  SERVICES  IN  THE  STATE
 SHALL NOT BE APPLIED TO A RETIRED PERSON'S EARNINGS WHEN CALCULATING THE
 EARNINGS  LIMITATIONS IMPOSED BY SUBDIVISIONS ONE AND TWO OF SECTION TWO
 HUNDRED TWELVE OF THIS ARTICLE.
   § 2. This act shall take effect immediately.
