Construction of certain terms of lease of lands used for fair purposes

§ 286-a. Construction of certain terms of lease of lands used for fair
purposes. The inability of any agricultural society entitled to receive
moneys from the state under section two hundred eighty-six of this
chapter, to hold its annual fair or exposition on lands leased to it for
that purpose which is occasioned by the use of such lands, for military
or war purposes, during either of the years nineteen hundred forty-two,
nineteen hundred forty-three and nineteen hundred forty-four, shall not
be deemed to be a failure to hold such fair or exposition contemplated
by the parties to, or within the meaning of the terms of any contract,
agreement or lease therefor, executed prior thereto, which provides for
the termination of such contract, agreement or lease upon the failure of
such agricultural society to hold its annual fair or exposition and no
action or proceeding for the termination of such a contract, agreement
or lease shall be maintained for failure of such agricultural society or
institute to hold its annual fair or exposition, where such failure is
occasioned by the use of such lands, building or property for military
or war purposes.
