    Civil and criminal prosecutions not merged

    Civil Practice Law & Rules (CVP) CHAPTER 8, ARTICLE 1

    § 106. Civil and criminal prosecutions not merged. Where the violation
    of a right admits of both a civil and criminal prosecution, the one is
    not merged in the other.
