Dear Superintendent Harris:
Thank you very much for the productive meeting with your staff on April 3rd to discuss the implementation of our legislation, "The Dyslexia Diagnosis Access Act" (A.2898/S.5481), as amended by chapter amendment (A.419/S.756). We greatly appreciated your team's engagement and willingness to collaborate closely on this issue. We are especially grateful for your team's suggestion to convene a follow-up meeting with our offices and key stakeholders to address implementation challenges. We will be in touch shortly to schedule this meeting.
Upon further reflection, we believe formal rulemaking by DFS pursuant to the State Administrative Procedure Act (SAPA), including a public comment period to allow for input from providers, professional associations, families, and other stakeholders, would be the most effective way to ensure consistent, detailed, and enforceable implementation across the insurance market. Please let us know if and how we can assist in initiating this process and what the appropriate next steps would be.
