Senator Patrick M. Gallivan (R-C, Elma) is urging residents in nine towns in southern Erie County to cooperate with officials from the New York State Department of Environmental Conservation (DEC) and the federal Environmental Protection Agency (EPA) as their investigation of possible radiological contamination in Western New York continues.

DEC and EPA agents plan to visit the towns of Aurora, Boston, Brant, Concord, Eden, Evans, Hamburg, Marilla, and Orchard Park to test for elevated levels of radiation. The field tests are a follow-up to aerial surveys conducted throughout the region. The agencies will not enter private property or conduct testing unless the owners give them permission. 

“The testing is being conducted as a precaution and does not mean that residents are at risk,” Senator Gallivan said. “I urge property owners to cooperate with the DEC and EPA as they conduct their research. My office will work both agencies as needed to ensure appropriate action, if needed, is taken.”

The DEC has indicated that elevated radiation levels detected in the past in the Southtowns were determined to be naturally occurring from bedrock in the area and not related to contamination. Testing has also been conducted on Grand Island and in parts of Niagara County. Ground surveys may include scanning for radiation levels using handheld equipment, as well as air or soil samples.

Meanwhile, Senator Gallivan co-sponsors legislation that would require radioactive waste to be considered hazardous waste under the New York Hazardous Waste Superfund program. Current law prohibits funds from the program from being used to address radiological contamination.
