BILL NUMBER: S5224 TITLE OF BILL : An act to amend the executive law, in relation to the duties of the municipal police training council PURPOSE : To authorize the Municipal Police Training Council to recommend to the governor rules and regulations with respect to the development of policies and procedures regarding the investigation, enforcement, and prevention of any act of cruelty to animals and to provide training to law enforcement on such policies and procedures. SUMMARY OF PROVISIONS : This bill amends the executive law by adding two new paragraphs (k) and (m) to subdivision 1 of section 840. Paragraph (k) authorizes the Municipal Police Training Council to recommend to the governor rules and regulations with respect to the development, maintenance, and dissemination of written policies and procedures for the identification and enforcement of animal cruelty laws pursuant to article twenty-six of the agriculture and markets law, any applicable sections of the penal law, and section 352.3 of the family court act as it applies to orders of protection for companion animals.

SCHNEIDERMAN -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to the duties of the municipal police training council THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 840 of the executive law is amended by adding two new paragraphs (k) and (m) to read as follows: (K) DEVELOPMENT, MAINTENANCE AND DISSEMINATION OF WRITTEN POLICIES AND PROCEDURES PURSUANT TO ARTICLE TWENTY-SIX OF THE AGRICULTURE AND MARKETS LAW, SECTION 352.3 OF THE FAMILY COURT ACT AS IT APPLIES TO COMPANION ANIMALS, AND APPLICABLE PROVISIONS OF THE PENAL LAW, REGARDING THE INVESTIGATION AND PREVENTION OF ANY ACT OF CRUELTY TO ANIMALS. (M) ESTABLISHMENT AND IMPLEMENTATION ON AN ONGOING BASIS, OF A TRAIN- ING PROGRAM FOR ALL CURRENT AND NEW POLICE OFFICERS AND PEACE OFFICERS REGARDING THE POLICIES AND PROCEDURES ESTABLISHED PURSUANT TO PARAGRAPH (K) OF THIS SUBDIVISION.
