TITLE OF BILL:
An act
to amend the public authorities law, in relation to prohibiting
officers and
employees of
the state to use the state
thruway system without paying tolls during
non-working hours

PURPOSE OR GENERAL IDEA OF BILL:
This bill would prohibit the practice of allowing employees and other
officers from using the New York State Thruway without paying tolls
when they are off duty. It specifically disallows all state agencies,
authorities and other state entities from using the system free of
charge.

SUMMARY OF SPECIFIC PROVISIONS:
Section 1 amends the public authorities law by adding a new section
which disallows the Thruway from offering state entities a off-work
hours free ezpass for employees of any state agency, authority or
entity a pass to access the New York State.

Section 2 gives the effective date.

JUSTIFICATION:
While during working hours, it is understandable that New York State
Thruway employees may pass through the tolls without charge due to
the traveling that their job may demand. It is not acceptable,
however, for these employees to be doing so during non-working hours
at the expense of the New York State. This legislation would prohibit
this odious practice which accounted for 14 million dollars in
expenses in just the last year alone.

AN ACT to amend the public authorities law, in relation  to  prohibiting
  officers  and  employees  of the state to use the state thruway system
  without paying tolls during non-working hours

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public  authorities  law  is amended by adding a new
section 388 to read as follows:
  S 388. LIMITATION ON POWERS OF THE AUTHORITY.  A DEPARTMENT,  AUTHORI-
TY,  DIVISION OR AGENCY OF THE STATE SHALL NOT OFFER OR PERMIT ANY OFFI-
CER OR EMPLOYEE OF SUCH DEPARTMENT, AUTHORITY, DIVISION OR AGENCY TO USE
A PASS TO ACCESS AND/OR USE THE THRUWAY SYSTEM WITHOUT THE OFFICER'S  OR
EMPLOYEE'S  PERSONAL PAYMENT OF TOLLS EXCEPT WHEN THE USE OF SUCH A PASS
AND/OR USE OF THE THRUWAY  SYSTEM  WITHOUT  PERSONAL  PAYMENT  OF  TOLLS
OCCURS  IN THE NORMAL COURSE OF THE EMPLOYMENT OR DUTIES OF SUCH OFFICER
OR EMPLOYEE.  THIS SECTION SHALL NOT DIMINISH THE RIGHTS OF ANY EMPLOYEE
PURSUANT TO A COLLECTIVE BARGAINING AGREEMENT.
  S 2. This act shall take effect immediately.
