BILL NUMBER:S7007 TITLE OF BILL: An act to amend the public service law, in relation to directing the public service commission to conduct a study on gas and electric supply prices Purpose: to direct the Public Service Commission and the Bulk System Operator to conduct a study on the causes of large price increases for electric and gas supply this past winter and provide policy recommendations to the legislature Summary of Provisions: Section 1. Requires the Public Service Commission and the Bulk system operator to conduct a study to determine the factors that caused major price spikes on consumer gas and electric bills this past winter. Section 2. Sets forth the effective Date Justification: This past winter saw some of the largest electricity supply price increases in recent memory. These increases across the state ranged from 15% to more than 60% and were a shock to consumers who struggled

MAZIARZ -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public service law, in relation to directing the public service commission to conduct a study on gas and electric supply prices THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 5 of the public service law is amended by adding a new subdivision 7 to read as follows: 7. A. WITHIN FORTY-FIVE DAYS OF THE EFFECTIVE DATE OF THIS SUBDIVI- SION, THE COMMISSION SHALL CONDUCT A STUDY IN COOPERATION AND CONSULTA- TION WITH THE BULK SYSTEM OPERATOR RELATING TO THE CAUSE OR CAUSES OF INCREASES IN CONSUMER PRICES FOR GAS AND ELECTRIC SUPPLY SERVICE DURING THE TIME PERIOD COMMENCING ON NOVEMBER FIRST, TWO THOUSAND THIRTEEN AND ENDING ON APRIL THIRTIETH, TWO THOUSAND FOURTEEN. B. UPON COMPLETION AND REVIEW OF THE DATA IN CONNECTION WITH THE STUDY, THE COMMISSION SHALL ISSUE A REPORT TO THE GOVERNOR AND THE LEGISLATURE WHICH SHALL INCLUDE RECOMMENDATIONS FOR STATUTORY AND REGU- LATORY CHANGES THAT MAY BE IMPLEMENTED IN ORDER TO MITIGATE FUTURE SUCH INCREASES IN GAS AND ELECTRIC SUPPLY PRICES. C. SUCH REPORT SHALL BE COMPLETED NO LATER THAN NOVEMBER FIFTEENTH, TWO THOUSAND FOURTEEN AND COPIES SHALL BE FORWARDED TO THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE, THE SPEAKER OF THE ASSEMBLY, THE CHAIR OF THE SENATE ENERGY AND TELECOMMUNICATIONS COMMITTEE, THE CHAIR OF THE ASSEMBLY ENERGY COMMITTEE AND ALSO POSTED ON THE DEPARTMENT'S WEBSITE. MAZIARZ, CARLUCCI, KENNEDY, LARKIN, LATIMER, RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommunications -- reported favorably from said committee and committed to the Committee on Finance -- reported favorably from said committee, ordered to first report, amended on first report, ordered to a second report and ordered reprinted, retaining its place in the order of second report AN ACT directing the public service commission to conduct a study on gas and electric supply prices; and providing for the repeal of such provision upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Gas and electric supply price study. a. Within forty-five days of the effective date of this act, the public service commission shall conduct a study in cooperation and consultation with the bulk system operator relating to the cause or causes of increases in consumer prices for gas and electric supply service during the time period commencing on November first, two thousand thirteen and ending on April thirtieth, two thousand fourteen. b. Upon completion and review of the data in connection with the study, the public service commission shall issue a report to the gover- nor and the legislature which shall include recommendations for statuto- ry and regulatory changes that may be implemented in order to mitigate future such increases in gas and electric supply prices. c. Such report shall be completed no later than November fifteenth, two thousand fourteen and copies shall be forwarded to the governor, the temporary president of the senate, the speaker of the assembly, the chair of the senate energy and telecommunications committee, the chair of the assembly energy committee and also posted on the department's website. S 2. This act shall take effect immediately and shall expire and be deemed repealed November 15, 2014.
