BILL NUMBER: S5840 TITLE OF BILL : An act to amend the social services law, in relation to establishing a certificate of need process for the assisted living program; and to establish a moratorium on the authorization of new assisted living programs in certain cases PURPOSE : To create a certificate of need process for the assisted living program. SUMMARY OF PROVISIONS : Section 1 of the bill deletes provisions requiring a competitive solicitation process for assisted living program (ALP) beds and creates a new certificate of need (CON) process that awards ALP beds based on demonstrated community need. In order to reduce the state cost of reviewing duplicative filings, the bill also allows existing ALP providers to add up to nine beds through an expedited review process. Finally, the bill also allows the director of budget to place a moratorium on the issuance of new beds if he or she determines that additional ALP beds would result in a net negative fiscal impact to the Medicaid program. Section 2 of the bill provides an effective date.
