BILL NUMBER:A10837 TITLE OF BILL: An act to amend the public health law, in relation to prohibiting smoking in correctional facilities PURPOSE OF THE BILL: This bill will prohibit smoking in New York State Correctional facilities. SUMMARY OF PROVISIONS: Section one of the bill amends section 1399-o of the public health law that adds correctional facilities to the list of public places that smoking is prohibited. Section two relates to the effective date. JUSTIFICATION: Over $300 million is spent each year on health care services for incarcerated individuals in New York correctional facili- ties. This bill prevents an unhealthy behavior that exacerbates these costs. This legislation will also protect the health of the non-smoking prisoners some of whom have sued the State for second hand smoking related illnesses. New York City already has a prohibition of smoking in city correctional facilities; put in place in 2003. PRIOR LEGISLATIVE HISTORY: New Bill. FISCAL IMPLICATIONS FOR STATE: None. EFFECTIVE DATE: This act shall take effect immediately.

LIFTON -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to prohibiting smok- ing in correctional facilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 17 and 18 of section 1399-o of the public health law, as amended by chapter 13 of the laws of 2003, are amended and a new subdivision 19 is added to read as follows: 17. zoos; [and] 18. bingo facilities[.]; AND 19. CORRECTIONAL FACILITIES AS DEFINED IN SECTION TWO OF THE CORRECTION LAW. S 2. This act shall take effect immediately.
