AN  ACT  to  amend  the  correction  law and the social services law, in
  relation to the placement of homeless sex offenders

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Section 168-f of the correction law is amended by adding a
new subdivision 7 to read as follows:
  7. IN THE EVENT THAT A CITY OR COUNTY COMMISSIONER OF SOCIAL  SERVICES
MOVES  OR PLACES A HOMELESS PERSON, WHOM SUCH COMMISSIONER KNOWS TO BE A
SEX OFFENDER REQUIRED TO REGISTER PURSUANT TO THIS ARTICLE, IN ANY  FORM
OF  TEMPORARY  EMERGENCY  HOUSING,  INCLUDING  A MOBILE HOME, TRAILER OR
SIMILAR STRUCTURE, SUCH COMMISSIONER SHALL,  WITHIN  TWENTY-FOUR  HOURS,
NOTIFY THE DIVISION AND THE LOCAL LAW ENFORCEMENT AGENCY IN THE VILLAGE,
TOWN  OR  CITY  WHERE  SUCH  HOUSING IS LOCATED AND PROVIDE THE NAME AND
ADDRESS OF THE SEX OFFENDER BEING PLACED. SUCH NOTICE SHALL SATISFY  THE
REQUIREMENTS OF SUBDIVISION FOUR OF THIS SECTION.
  S 2. Section 136 of the social services law is amended by adding a new
subdivision 6 to read as follows:
  6.  NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION TWO OF THIS SECTION,
IN THE EVENT THAT A CITY OR COUNTY COMMISSIONER OF SOCIAL SERVICES MOVES
OR PLACES A HOMELESS PERSON, WHO SUCH COMMISSIONER KNOWS  TO  BE  A  SEX
OFFENDER   REQUIRED  TO  REGISTER  PURSUANT  TO  ARTICLE  SIX-C  OF  THE
CORRECTION LAW, IN ANY FORM OF TEMPORARY EMERGENCY HOUSING, INCLUDING  A
MOBILE  HOME,  TRAILER  OR  SIMILAR  STRUCTURE, SUCH COMMISSIONER SHALL,
WITHIN TWENTY-FOUR  HOURS,  NOTIFY  THE  DIVISION  OF  CRIMINAL  JUSTICE
SERVICES  AND  THE  LOCAL LAW ENFORCEMENT AGENCY IN THE VILLAGE, TOWN OR
CITY WHERE SUCH HOUSING IS LOCATED AND PROVIDE THE NAME AND  ADDRESS  OF
THE  SEX  OFFENDER  BEING PLACED. SUCH NOTICE SHALL SATISFY THE REQUIRE-
MENTS OF SUBDIVISION FOUR OF SECTION ONE HUNDRED  SIXTY-EIGHT-F  OF  THE
CORRECTION LAW.
  S 3. This act shall take effect immediately.
