AN ACT to amend the education law,  in  relation  to  providing  aid  to
  school  districts for expenses related to the school districts' use of
  electricity, propane, natural gas, and/or heating oil for  the  school
  year

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 3602 of the education law is amended  by  adding  a
new subdivision 27 to read as follows:
  27.  AID FOR ELECTRICITY, PROPANE, NATURAL GAS, AND/OR HEATING OIL FOR
THE SCHOOL YEAR. A. COMMENCING WITH AID  PAYABLE  IN  THE  TWO  THOUSAND
TEN--TWO THOUSAND ELEVEN SCHOOL YEAR, THE COMMISSIONER IS HEREBY AUTHOR-
IZED  TO  APPORTION TO ANY SCHOOL DISTRICT AID PURSUANT TO THIS SUBDIVI-
SION FOR ITS APPROVED EXPENDITURES, IN EXCESS OF BASE YEAR AID RECEIVED,
FOR EXPENSES RELATED TO THE COST OF ELECTRICITY, PROPANE,  NATURAL  GAS,
AND/OR HEATING OIL FOR THE SCHOOL YEAR.
  B. AID PURSUANT TO THIS SUBDIVISION SHALL EQUAL TWENTY-FIVE PERCENT OF
THE  SCHOOL DISTRICTS' COST FOR ITS USE OF ELECTRICITY, PROPANE, NATURAL
GAS, AND/OR HEATING OIL THROUGHOUT THE SCHOOL YEAR.
  S 2. This act shall take effect immediately.
