AN ACT to amend the public health law, in relation to exempting commuter
  colleges from the requirement of maintaining measles, mumps and rubel-
  la (MMR) and meningococcal meningitis records

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 1 of section 2165 of the public health  law  is
amended by adding a new paragraph e to read as follows:
  E.  THE  TERM  "COMMUTER COLLEGE" MEANS ANY TWO-YEAR COMMUNITY COLLEGE
NOT HAVING ANY STUDENT HOUSING.
  S 2. Section 2165 of the public health law is amended by adding a  new
subdivision 14 to read as follows:
  14.  THIS  SECTION  SHALL NOT APPLY TO COMMUTER COLLEGES AS DEFINED IN
SUBDIVISION ONE OF THIS SECTION.
  S 3. Subdivision 1 of section 2167 of the public health law is amended
by adding a new paragraph d to read as follows:
  D. THE TERM "COMMUTER COLLEGE" MEANS ANY  TWO-YEAR  COMMUNITY  COLLEGE
NOT HAVING ANY STUDENT HOUSING.
  S  4. Section 2167 of the public health law is amended by adding a new
subdivision 7 to read as follows:
  7. THIS SECTION SHALL NOT APPLY TO COMMUTER  COLLEGES  AS  DEFINED  IN
SUBDIVISION ONE OF THIS SECTION.
  S 5. This act shall take effect immediately.
