AN  ACT  to  amend the general city law, in relation to the reporting of
  energy consumption and production

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  general  city law is amended by adding a new section
18-e to read as follows:
  S 18-E. REPORTING OF ENERGY CONSUMPTION AND PRODUCTION IN CITY BUDGET.
1. THE MAYOR OR OTHER  OFFICER  CHARGED  WITH  THE  PREPARATION  OF  THE
PRELIMINARY OR TENTATIVE BUDGET SHALL ANNUALLY INCLUDE A REPORT ON ENER-
GY  CONSUMPTION AND EXPENSES FOR THE FOUR PREVIOUS FISCAL YEARS, PROJEC-
TIONS FOR THE UPCOMING FISCAL YEAR, AND THE PROJECTIONS FOR  THE  SUBSE-
QUENT  FOUR FISCAL YEARS. THE REPORT SHALL INCLUDE FOR EACH FISCAL YEAR,
BUT NOT BE LIMITED TO, THE FOLLOWING INFORMATION:
  A. THE TOTAL NUMBER OF CITY-OWNED BUILDINGS  AND  FACILITIES  AND  THE
TOTAL SQUARE FOOTAGE FOR SUCH BUILDINGS AND FACILITIES;
  B.  THE  TOTAL ANNUAL ENERGY CONSUMPTION, LISTED BY ENERGY SOURCE, FOR
ALL CITY-OWNED BUILDINGS AND FACILITIES;
  C. THE TOTAL ANNUAL ENERGY COST CALCULATED PER SQUARE FOOT, AND LISTED
BY ENERGY SOURCE, FOR ALL CITY-OWNED BUILDINGS AND FACILITIES;
  D. THE TOTAL ANNUAL COST FOR FUEL USED BY CITY-OWNED VEHICLES,  LISTED
BY FUEL TYPE;
  E.  TO  THE GREATEST EXTENT POSSIBLE, A BREAKDOWN BY PERCENTAGE OF THE
TOTAL RENEWABLE ENERGY USED BY ALL CITY-OWNED BUILDINGS AND FACILITIES;
  F. TOTAL CITYWIDE INVESTMENTS IN THE PRODUCTION OF ENERGY, BOTH  USING

  G. TOTAL CITYWIDE EXPENDITURES ON ENERGY CONSERVATION  AND  EFFICIENCY
EFFORTS.
  2.  FOR  THE  PURPOSE  OF  THIS SECTION RENEWABLE ENERGY IS DEFINED AS
ENERGY PRODUCED FROM THE FOLLOWING SOURCES: SOLAR  THERMAL,  PHOTOVOLTA-
ICS,  WIND, HYDROELECTRIC, GEOTHERMAL ELECTRIC, GEOTHERMAL GROUND SOURCE
HEAT, TIDAL ENERGY, WAVE ENERGY, OCEAN THERMAL, AND FUEL CELLS.
  S 2. This act shall take effect immediately and shall apply to  cities
with a population of 30,000 or more according to the 2000 federal decen-
nial  census commencing July 1, 2010; and this act shall apply to cities
with a population of less than 30,000  according  to  the  2000  federal
decennial census commencing July 1, 2011.

                                BILL NUMBER:A8346B

TITLE OF BILL:  An act to amend the general city law, in relation to the
reporting of energy consumption and production

PURPOSE  OR  GENERAL  IDEA  OF  BILL:  This bill would require cities of
greater than 30,000 in population to  provide  detail  in  their  annual
budgets on the costs of energy consumption and production.

SUMMARY  OF  SPECIFIC  PROVISIONS:  This bill would require the mayor or
other officer charged with preparation of a city's budget to  include  a
report on energy consumption and expenses. The report would include:

* the total number and square footage of city-owned building and facili-
ties;

* the total energy consumption listed by energy source;

* the total energy cost by square foot and listed by energy source;

*  the  total  cost for fuel used by city-owned vehicles, listed by fuel
type and average mileage per vehicle class;

* the percentage of renewable energy used by  all  city-owned  buildings
and facilities;

*  the  total  citywide  investments in the production of energy; and, a
total  citywide  expenditure  on  energy  conservation  and   efficiency
efforts.

The  report  would include the expenditures for the four previous fiscal
years, the projected expenditure for the upcoming fiscal year,  and  the
projections for the following four fiscal years.

JUSTIFICATION:  New York's total energy consumption is among the highest
in the United States according to the Energy Information Administration.
A recent report by the New York State Comptroller states that  electric-
ity  costs  account for over 50 percent of total energy spending in most
local governments in New York. While some cities have started  to  focus
on  their  energy  consumption,  more needs to be done. This legislation
would help both city governments and residents understand the  level  of
expense  their  city  incurs for energy production and consumption. This
knowledge will help in planning for future needs and projects and initi-
atives to reduce energy consumption and costs.

PRIOR LEGISLATIVE HISTORY: New bill.

FISCAL IMPLICATIONS: None to the State.

EFFECTIVE DATE: This act shall take effect immediately and  shall  apply
to  cities  with  a  population  of 30,000 or more according to the 2000
federal census.

OF  THIS  SECTION SHALL APPLY ONLY TO CITIES WITH A POPULATION OF THIRTY
THOUSAND OR MORE ACCORDING TO SUCH CENSUS. ANY CITY WITH A POPULATION OF
THIRTY THOUSAND OR MORE ACCORDING TO THE TWO THOUSAND TEN FEDERAL DICEN-
NIAL CENSUS WHICH HAD A POPULATION OF LESS THAN THIRTY THOUSAND  ACCORD-
ING  TO  THE TWO THOUSAND FEDERAL DECENNIAL CENSUS SHALL COMPLY WITH THE
PROVISIONS OF THIS SECTION WITHIN SIX MONTHS OF THE PUBLICATION  OF  THE
TWO THOUSAND TEN FEDERAL DECENNIAL CENSUS.
  S 2. This act shall take effect immediately.
