BILL NUMBER: S1169 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to mandatory seat belt use PURPOSE OR GENERAL IDEA OF BILL : To require the use of seat belts by all passengers in a motor vehicle riding in both the front and rear seats. JUSTIFICATION : The institution of a mandatory seat belt law for all front seat passengers has saved lives. According to the New York State Department of Motor Vehicles, in 1984, the year the seat belt law was enacted, approximately 16% of individuals wore seat belts. Also, one thousand twelve (1,012) people who were unrestrained died in motor vehicle crashes. Just one year after the law was enacted, the compliance rate was up to 57% of individuals and unrestrained fatalities fell to 644. A little over 10 years later, the compliance rate was up to 73%. In studies done by the United States Department of Transportation, approximately 52% of rear seat passengers do not use safety belts. Recognizing the serious injuries that may be caused to other passengers or the driver of a motor vehicle by an unrestrained occupant of the vehicle, 14 states have adopted legislation requiring

BILL NUMBER: S1169A TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to mandatory seat belt use PURPOSE OR GENERAL IDEA OF BILL : This legislation would extend the mandated use of a restraint in the back seat of a motor vehicle to the age of eighteen, in turn safeguarding a particularly vulnerable segment of the passenger population. JUSTIFICATION : The use of seatbelts has proven to mitigate the occurrences of death and severe injury caused during motor vehicle accidents. This legislation is simply extending the mandatory use of restraints in the back seat in hopes of further reducing fatalities and severe injuries. Additionally, habitual use of safety belts as young adults may translate to increased use as adults. SUMMARY OF PROVISIONS : Section 1: Subdivision 3 of section 1229-c of the vehicle an traffic law, as added by chapter 365 of the laws of 1984, is amended to require the use of seatbelts by all individuals under the age of eighteen in the back seat of a motor vehicle.

No person shall operate a motor vehicle unless such person is restrained by a safety belt approved by the commissioner. No person [sixteen years of age or over shall be a passenger in the front seat of a motor vehicle unless such person is restrained by a safety belt approved by the commissioner.] SHALL BE A PASSENGER IN THE FRONT SEAT OF A MOTOR VEHICLE UNLESS SUCH PERSON IS RESTRAINED BY A SAFETY BELT APPROVED BY THE COMMISSIONER. NO PERSON UNDER THE AGE OF EIGHTEEN SHALL BE A PASSENGER IN THE BACK SEAT OF A MOTOR VEHICLE UNLESS SUCH PERSON IS RESTRAINED BY A SAFETY BELT APPROVED BY THE COMMISSIONER. S 2. SUMMARY OF SPECIFIC PROVISIONS : The bill amends subdivision 3 of §1229-c of the Vehicle and Traffic Law to require the use of seat belts by all passengers sixteen years of age or older riding in any seating position in a motor vehicle. JUSTIFICATION : The institution of a mandatory seat belt law for all front seat passengers has saved lives. According to the New York State Department of Motor Vehicles, in 1984, the year the law was enacted, approximately 16% of individuals wore seat belts. By 2008, 24 years after the law was enacted, the compliance rate was up to 89%. The Governor's Traffic Safety Committee has indicated that thirty percent
