BILL NUMBER: S2289 TITLE OF BILL : An act to amend the public authorities law, in relation to creating a commercialization assistance fund in the New York state foundation for science, technology and innovation PURPOSE : To create the Commercialization Assistance Fund, which would allow the New York State Science and Technology Foundation (NYSTIF) to provide grants and invest in new companies that promote the commercialization of new technologies developed at New York state research institutions. SUMMARY OF PROVISIONS : Section 1 describes the legislative intent. Section 2 amends Section 3150 of the public authorities law by defining "research entity." Section 3 adds a new Section 3154-a to create a commercialization assistance fund and defines the purposes of the fund, the types of grants to be made available through the fund, the terms of such grants, and the criteria to be used in evaluating applications for funds. The foundation shall give priority to those projects that have the greatest potential for commercial success and eventual job creation in New York state, or that will have the largest positive impact on the health and welfare of the state's citizens or on the natural or built environment. BILL NUMBER: S2289A TITLE OF BILL : An act to amend the public authorities law, in relation to creating a regional commercialization technology fund in the New York state foundation for science, technology and innovation; and to amend the executive law, in relation to the research development plan PURPOSE OR GENERAL IDEA OF BILL : To create a fund to assist early-stage commercialization of new technologies in New York State. SUMMARY OF SPECIFIC PROVISIONS : Awards would be made competitively to academic research institutions, regional technology development corporations, centers of advanced technology or other technology-based economic development organizations. Each proposal would be awarded between five hundred thousand and one million dollars. These regional entities would then award grants to research entities for early stage commercialization; start-up companies for commercialization of property licensed from State research entities; and, on a matching basis, to small business cooperating with research institutions to translate promising discoveries into commercially viable products. Grants would not exceed one hundred thousand dollars.

Section 3150 of the public authorities law, as amended by section 4 of part C of chapter 63 of the laws of 2005, is amended to read as follows: S 3150. Definitions. As used in this [section] TITLE: 1. "Foundation" shall mean the New York state foundation for science, technology and innovation created by this title; 2. "Executive director" shall mean the executive director of the foun- dation; 3. "Board" shall mean the New York state foundation for science, tech- nology and innovation board; 4. "Regional partnerships" shall mean any association or group which is: (a) comprised of local economic development organizations and a center of excellence as defined by section three of part T of chapter eighty-four of the laws of two thousand two, or in the absence of such center in the region, at least one institution of higher education involved in commercialization efforts similar to such centers of excel- lence and may include a combination of private businesses, business support organizations, commercial lending institutions, venture capital companies, angel investor networks or foundations; (b) formed for the EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
