BILL NUMBER: S2485 TITLE OF BILL : An act to amend the education law, in relation to reports by the education department PURPOSE OR GENERAL IDEA OF BILL : Requires education department to make annual report to governor and legislature on outdoor play space in New York city public schools SUMMARY OF SPECIFIC PROVISIONS : Adds a new section 115 to the education law requiring the State Education Department to make an annual report to the governor and the state legislature on: * The availability, size and condition of outdoor facilities for physical activity at each New York City public school, including whether each school has a playground, schoolyard, athletic fields or track on its grounds or a nearby park suitable for physical activity; * Planned inclusion of outdoor play space in new capacity-generating construction projects in New York City public schools including new

KLEIN -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to reports by the educa- tion department THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 115 to read as follows: S 115. REPORT ON OUTDOOR PLAYSPACE IN THE NEW YORK CITY PUBLIC SCHOOLS. THE DEPARTMENT SHALL MAKE AN ANNUAL REPORT TO THE GOVERNOR AND THE LEGISLATURE NO LATER THAN DECEMBER FIRST OF EACH YEAR OF ITS FIND- INGS, CONCLUSIONS AND RECOMMENDATIONS ON THE FOLLOWING MATTERS REGARDING THE NEW YORK CITY PUBLIC SCHOOLS AND SHALL SUBMIT WITH ITS REPORTS SUCH LEGISLATIVE PROPOSALS AS IT DEEMS NECESSARY TO IMPLEMENT ITS RECOMMENDA- TIONS: 1. THE AVAILABILITY, SIZE AND CONDITION OF OUTDOOR FACILITIES FOR PHYSICAL ACTIVITY AT EACH NEW YORK CITY PUBLIC SCHOOL, INCLUDING WHETHER EACH SCHOOL HAS A PLAYGROUND, SCHOOLYARD, ATHLETIC FIELDS OR TRACK ON ITS GROUNDS OR A NEARBY PARK SUITABLE FOR PHYSICAL ACTIVITY; 2. PLANNED INCLUSION OF OUTDOOR PLAYSPACE IN NEW CAPACITY-GENERATING CONSTRUCTION PROJECTS IN NEW YORK CITY PUBLIC SCHOOLS INCLUDING NEW SCHOOLS AND THE IMPACT OF MAJOR RENOVATIONS OR CHANGES TO EXISTING OUTDOOR FACILITIES; AND 3. THE UTILIZATION OF TEMPORARY CLASSROOM UNITS (TCUS) AT EACH NEW YORK CITY PUBLIC SCHOOL, INCLUDING THE IMPACT ON OUTDOOR PLAYSPACE, THE LENGTH AND EXPECTED DURATION OF USE AND FUTURE PLANS FOR USE OF TCUS AT THE SCHOOL. BILL NUMBER:S2485A TITLE OF BILL: An act to amend the education law, in relation to directing the chancellor of a city school district in a city having a population of one million or more to inventory and report upon the outdoor playgrounds within such district PURPOSE OR GENERAL IDEA OF BILL: Requires the Chancellor of the New York City School District to compile an inventory of the outdoor playgrounds in such school district and to prepare a report on certain aspects of the condition and use of such playgrounds. SUMMARY OF SPECIFIC PROVISIONS: Section 1: Adds a new Education Law section 2556(14) to require the Chancellor of the New York city School District to prepare an inventory and report on the following items related to school district outdoor playgrounds: - identify each and every outdoor playground located at or associated with schools, their location, size, and physical condition. - identify which playgrounds are in fact utilized as outdoor

KLEIN, DIAZ, ESPADA, HASSELL-THOMPSON, HUNTLEY, KRUEGER, MONTGOMERY, SAMPSON -- read twice and ordered printed, and when printed to be committed to the Committee on Education -- recom- mitted to the Committee on Education in accordance with Senate Rule 6, sec. 8 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the education law, in relation to directing the chancel- lor of a city school district in a city having a population of one million or more to inventory and report upon the outdoor playgrounds within such district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2556 of the education law is amended by adding a new subdivision 14 to read as follows: 14. A. THE CHANCELLOR OF A CITY SCHOOL DISTRICT IN A CITY HAVING A POPULATION OF ONE MILLION OR MORE SHALL COMPILE AN INVENTORY OF AND ISSUE A WRITTEN REPORT ABOUT THE OUTDOOR PLAYGROUNDS IN THE CITY SCHOOL DISTRICT. SUCH INVENTORY AND REPORT SHALL: (I) IDENTIFY EACH OUTDOOR PLAYGROUND LOCATED AT EDUCATIONAL FACILI- TIES, AS DEFINED IN SUBDIVISION NINE OF SECTION TWENTY-FIVE HUNDRED NINETY-A OF THIS TITLE, OF THE CITY SCHOOL DISTRICT. EACH OUTDOOR PLAY- GROUND SHALL BE IDENTIFIED BY THE COMMUNITY SCHOOL DISTRICT IN WHICH THE OUTDOOR PLAYGROUND IS LOCATED, ITS ADDRESS, SIZE AND PHYSICAL CONDITION; (II) IDENTIFY WHICH OUTDOOR PLAYGROUNDS ARE USED FOR PHYSICAL EDUCA- TION, ACTIVITY AND/OR RECREATION; FOR EACH SUCH OUTDOOR PLAYGROUND, A DESCRIPTION OF HOW OFTEN STUDENTS OF THE CITY DISTRICT USE THE OUTDOOR PLAYGROUND, THE ACTIVITIES CONDUCTED, AND ANY LIMITATIONS ON THE USES OF THE PLAYGROUND; (III) IDENTIFY WHICH OUTDOOR PLAYGROUNDS ARE NOT USED FOR PHYSICAL EDUCATION, ACTIVITY OR RECREATION.
