BILL NUMBER: S3555 TITLE OF BILL : An act to amend the public officers law, in relation to charging for postage or waiving fees for the reproduction of records PURPOSE OR GENERAL IDEA OF BILL : Allows agencies to charge for postage when records are mailed through a FOIL request and waive fees for the reproduction of records. SUMMARY OF SPECIFIC PROVISIONS : Provides that: * Agencies may charge for postage when records are mailed in response to requests under the Freedom of Information Law, and * Agencies shall be permitted to waive fees for the reproduction of records required by requests received under the Freedom of Information Law. JUSTIFICATION : Since 1979, many agencies have routinely waived fees for small or routine FOIL requests, as the time and cost involved in doing the paperwork for such small transactions would exceed the amount that they could reasonably bill to the requesting party. Agencies should be given clear statutory authority enabling them to waive fees when it

SERRANO -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the public officers law, in relation to charging for postage or waiving fees for the reproduction of records THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 87 of the public officers law is amended by adding two new paragraphs (d) and (e) to read as follows: (D) NOTHING IN THIS SECTION SHALL PROHIBIT AGENCIES FROM CHARGING FOR POSTAGE WHEN RECORDS ARE MAILED. (E) NOTHING IN THIS SECTION SHALL PROHIBIT AGENCIES FROM WAIVING A FEE FOR THE REPRODUCTION OF RECORDS. S 2. This act shall take effect immediately.
