BILL NUMBER: S3903 TITLE OF BILL : An act to amend the general municipal law, in relation to cooperative bidding by libraries and library systems PURPOSE : This legislation would amend section 119-n of the general municipal law to permit public libraries and library systems to engage in cooperative bidding. SUMMARY OF PROVISIONS : Section one amends subdivision a of 119-n of the general municipal law by adding public libraries and library systems to the definition of "municipal corporation". Section two provides the effective date. JUSTIFICATION : Currently, public libraries or library systems are not permitted to pool their joint needs for services or products together for cooperative bidding purposes. Each library is required to go out on its own to get bids for services and products, reducing its ability to get bulk discounting or better pricing that would be available through cooperative purchasing or joint bidding. OPPENHEIMER -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the general municipal law, in relation to cooperative bidding by libraries and library systems THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision a of section 119-n of the general municipal law, as amended by chapter 413 of the laws of 1991, is amended to read as follows: a. The term "municipal corporation" means a county outside the city of New York, a city, a town, a village, a board of cooperative educational services, fire district [or], a school district, PUBLIC LIBRARY OR LIBRARY SYSTEM. S 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. BILL NUMBER: S3903A TITLE OF BILL : An act to amend the education law, in relation to cooperative competitive bidding by libraries and library systems PURPOSE OR GENERAL IDEA OF BILL : This legislation would amend section 255 of the education law to permit public libraries and library systems to engage in cooperative competitive bidding. SUMMARY OF SPECIFIC PROVISIONS : Section one amends section 255 of the education law by adding a new subdivision six that permits public libraries and library systems to enter into, amend, cancel and terminate agreements for performance, for the purpose of cooperatively bidding for equipment, supplies and services, provided the bidding meets criteria as outlined in this legislation. Section two provides the effective date. THE BOARD OF TRUSTEES OF ANY TWO, OR MORE, PUBLIC LIBRARIES, PUBLIC LIBRARY SYSTEMS, REFERENCE AND RESEARCH LIBRARY RESOURCES SYSTEMS, AS DEFINED IN THIS CHAPTER, SHALL HAVE THE POWER TO ENTER INTO, AMEND, CANCEL AND TERMINATE AGREEMENTS FOR PERFORMANCE AMONG THEMSELVES OR ONE FOR THE OTHER OF THEIR RESPECTIVE FUNCTIONS, FOR THE PURPOSE OF COOPERA- TIVELY ADVERTISING AND AWARDING BIDS FOR EQUIPMENT, SUPPLIES AND SERVICES, PROVIDED: A. SUCH ADVERTISING AND AWARDS HAVE BEEN MADE IN ACCORDANCE WITH THE REQUIREMENTS OF ARTICLE FIVE-A OF THE GENERAL MUNICIPAL LAW; B. THE PURCHASING AND MAKING OF CONTRACTS SHALL BE SUBJECT TO GENERAL LAWS APPLICABLE THERETO; AND C. THAT ANY SUCH AGREEMENTS SHALL INCLUDE A MANNER OF RESPONDING FOR ANY LIABILITIES THAT MIGHT BE INCURRED IN THE OPERATION OF THE JOINT SERVICE OR AGREEMENT. S 2.
