BILL NUMBER: S5822 TITLE OF BILL : An act to amend the education law, in relation to the calculation of contingency budget percentage increases in total spending over a district's total spending under the school district budget for the prior school year; and providing for the repeal of such provisions upon expiration thereof PURPOSE : To permit school districts that will be operating on a contingency budget for the 2010-11 school year to use a five year average CPI in calculating the allowable total spending increases permitted under a contingency budget EXISTING LAW : Existing law provides that a contingency budget for a school district shall not increase by more than 120% of the Consumer Price Index or 4%, whichever is less, over the prior school year. JUSTIFICATION : The projected CPI for 2009 is currently -0.8, a negative number because we are experiencing a deflationary period. Under current law a contingency budget for a school district may not increase by more than 120% of the Consumer Price Index or 4%, whichever is less. This would

OPPENHEIMER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the education law, in relation to the calculation of contingency budget percentage increases in total spending over a district's total spending under the school district budget for the prior school year; and providing for the repeal of such provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph a of subdivision 4 of section 2023 of the educa- tion law, as added by section 24 of part A of chapter 436 of the laws of 1997, is amended to read as follows: a. The contingency budget shall not result in a percentage increase in total spending over the district's total spending under the school district budget for the prior school year that exceeds the lesser of: (i) THE AVERAGE OF THE PREVIOUS FIVE YEARS OF the result obtained when one hundred twenty percent is multiplied by the percentage increase in the consumer price index, with the result rounded to two decimal places; or (ii) four percent. S 2. This act shall take effect July 1, 2009 and shall apply to school district budget votes for the 2010-11 school year and shall expire June 30, 2010 when upon such date the provisions of this act shall be deemed repealed.
