BILL NUMBER: S7815 TITLE OF BILL : An act to legalize, validate, ratify and confirm the establishment and funding of water district no. 7 in the town of Brutus, county of Cayuga PURPOSE OR GENERAL IDEA OF BILL : The purpose of the bill is to legalize, validate, ratify and confirm the establishment and funding of water district No. 7 in the town of Brutus in Cayuga County. SUMMARY OF SPECIFIC PROVISIONS : Section 1 legalizes, validates, ratifies and confirms establishment and funding of water district no. 7. Section 2 explains the need for the validating act. Section 3 contains the repayment plan for the installment bond. Section 4 contains the effective date. JUSTIFICATION :

VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to legalize, validate, ratify and confirm the establishment and funding of water district no. 7 in the town of Brutus, county of Cayu- ga THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any provision of the local finance law, the general municipal law or any law, all proceedings and actions had and taken by the town of Brutus in the county of Cayuga, in relation to establishing and funding water district no. 7 are hereby legalized, validated, ratified and confirmed. S 2. The town board of Brutus drilled a water line under the New York state thruway at a cost of $35,000.00. The New York state thruway was under repairs and if the town of Brutus had not had access until after the thruway was repaired, the cost of installing the water line would have been in excess of $200,000.00. Thus, the actions of the town saved the taxpayers a significant sum of money. The town board of Brutus was unable to properly post notices and public hearings for its actions because of the necessity for quick action to install the pipe when the access was ideal due to the thruway construction. S 3. The town of Brutus took a statutory installment bond with Savan- nah Bank in the amount of $35,000.00. This will be paid over a two year period at 1.5 percent interest. The district has been formed and will now assume the cost of the bond and repay advance to the general fund. S 4. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD17124-01-0
