TITLE OF BILL: An act to amend the social services law, in relation to
the prohibition of landlord harassment of group family day care homes
and family day care homes
PURPOSE OR GENERAL IDEA OF THE BILL: This bill addresses the concerns
of landlords harassing tenants operating group and family day cares in
their homes.
SUMMARY OF PROVISIONS: This bill amends the subdivision 13 and adds
subdivision 14 of section 390 of the social services law, as amended by
chapter 160 of the laws of 2003, is amended to read as follows:
Section 13: Notwithstanding any other provision of law, this section,
except for subdivision fourteen of this section, shall not apply to
child day care centers in the city of New York.
Section 14: Any family day care home or group family day care home
operating under a license issued pursuant to this section shall not be
punished, harassed or evicted by any landlord for the lawful operation
thereof.
JUSTIFICATION:; Many tenants who operate a family day care within their
apartments are harassed and abused by their landlords. Some landlords
demand that these tenants pay more rent or be added to their property

AN ACT to amend the social services law, in relation to the prohibition
of landlord harassment of group family day care homes and family day
care homes
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 13 of section 390 of the social services law,
as amended by chapter 160 of the laws of 2003, is amended to read as
follows:
13. Notwithstanding any other provision of law, this section, except
for [paragraph (a-1) of] subdivision [two-a] FOURTEEN of this section,
shall not apply to child day care centers in the city of New York.
S 2. Section 390 of the social services law is amended by adding a new
subdivision 14 to read as follows:
14. ANY FAMILY DAY CARE HOME OR GROUP FAMILY DAY CARE HOME OPERATING
UNDER A LICENSE ISSUED PURSUANT TO THIS SECTION SHALL NOT BE PUNISHED,
HARASSED OR EVICTED BY ANY LANDLORD FOR THE LAWFUL OPERATION THEREOF.
S 3. This act shall take effect immediately.
