AN  ACT to amend the social services law, in relation to the prohibition
  of landlord harassment of group family day care homes and  family  day
  care homes

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 13 of section 390 of the social  services  law,
as  amended  by  chapter  160 of the laws of 2003, is amended to read as
follows:
  13. Notwithstanding any other provision of law, this  section,  except
for  [paragraph  (a-1) of] subdivision [two-a] FOURTEEN of this section,
shall not apply to child day care centers in the city of New York.
  S 2. Section 390 of the social services law is amended by adding a new
subdivision 14 to read as follows:
  14. ANY FAMILY DAY CARE HOME OR GROUP FAMILY DAY CARE  HOME  OPERATING
UNDER  A  LICENSE ISSUED PURSUANT TO THIS SECTION SHALL NOT BE PUNISHED,
HARASSED OR EVICTED BY ANY LANDLORD FOR THE LAWFUL OPERATION THEREOF.
  S 3. This act shall take effect immediately.
