AN ACT to amend the public health law, in relation to  the  transitional
  care unit demonstration program

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 1 of section 2802-a of the public  health  law,
as  added  by section 87 of part B of chapter 58 of the laws of 2005, is
amended to read as follows:
  1. Notwithstanding any other provision of law  to  the  contrary,  the
commissioner is authorized to approve up to [five] TEN general hospitals
within  the  state to operate transitional care units by and within such
general hospitals. For purposes of  this  section,  "transitional  care"
shall  mean  sub  acute  care services provided to patients of a general
hospital who no longer require acute  care  general  hospital  inpatient
services,  but  continue  to need specialized medical, nursing and other
hospital ancillary services and are not yet appropriate for discharge.
  S 2. This act shall take effect immediately, provided,  however,  that
the  amendments  made  to  subdivision 1 of section 2802-a of the public
health law made by section one of this act shall not affect  the  repeal
of such section and shall be deemed repealed therewith.
