BILL NUMBER: S3532 TITLE OF BILL : An act to amend the public health law, in relation to the transitional care unit demonstration program PURPOSE OR GENERAL IDEA OF BILL : To authorize the commissioner of health to approve the establishment and operation of additional transitional care units demonstrations in general hospitals. SUMMARY OF SPECIFIC PROVISIONS : Section 1 amends subdivision 1 of section 2802-a to the public health law to authorize an additional five transitional care unit demonstration projects under the TCU demonstration program. Section 2 provides for an immediate effective date. EXISTING LAW : PHL 2802-a authorizes transitional care unit demonstration programs at up to five general hospitals.

FOLEY -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to the transitional care unit demonstration program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 2802-a of the public health law, as added by section 87 of part B of chapter 58 of the laws of 2005, is amended to read as follows: 1. Notwithstanding any other provision of law to the contrary, the commissioner is authorized to approve up to [five] TEN general hospitals within the state to operate transitional care units by and within such general hospitals. For purposes of this section, "transitional care" shall mean sub acute care services provided to patients of a general hospital who no longer require acute care general hospital inpatient services, but continue to need specialized medical, nursing and other hospital ancillary services and are not yet appropriate for discharge. S 2. This act shall take effect immediately, provided, however, that the amendments made to subdivision 1 of section 2802-a of the public health law made by section one of this act shall not affect the repeal of such section and shall be deemed repealed therewith. SUMMARY OF PROVISIONS : Section 1 amends subdivision 1 of section 2802-a to the public health law to authorize an additional five transitional care unit demonstration projects under the TCU demonstration program. Section 2 extends the demonstration program an additional five years. Section 3 provides for an immediate effective date. JUSTIFICATION : Transitional care units are designed to facilitate a smoother, more timely and appropriate transition from acute care to discharge for those patients 65 years or older.
