AN  ACT  to amend the education law, in relation to crediting of student
  progress in licensed trade or registered business schools

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Paragraph f of subdivision 4 of section 5002 of the educa-
tion law, as added by chapter 457 of the laws of  2003,  is  amended  to
read as follows:
  f.  Notwithstanding  any other provision of [the] law, a [not-for-pro-
fit] LICENSED TRADE OR registered business school, [that is eligible for
participation in the tuition assistance program and which  has  national
accreditation]  ACCREDITED  BY  AN  ACCREDITING AGENCY RECOGNIZED BY THE
UNITED STATES DEPARTMENT OF EDUCATION, may[, for the purpose  of  calcu-
lation of federal financial aid amounts only,] measure students' academ-
ic  progress  in  an  approved  curriculum in non-degree granting credit
hours, based upon [a national] SUCH accrediting agency's conversion  and
approval  of  clock hours to non-degree GRANTING credit hours.  [For the
purposes of this paragraph, "national accreditation" shall mean accredi-
tation by a national accrediting agency as defined in the commissioner's
regulations.] THE SCHOOLS' CATALOG AND ENROLLMENT AGREEMENT SHALL  STATE
THAT  THE NON-DEGREE GRANTING CREDIT HOURS DO NOT LEAD TO ANY DEGREE AND
ARE NOT EQUIVALENT TO A CREDIT HOUR OFFERED AT A DEGREE GRANTING  INSTI-
TUTION. THE SCHOOLS' CATALOG WILL LIST THE LENGTH OF EACH COURSE IN BOTH
CLOCK  HOURS  AND THE CORRESPONDING AMOUNT OF NON-DEGREE GRANTING CREDIT
HOURS.
  S 2. This act shall take effect immediately.
