BILL NUMBER:A454 TITLE OF BILL: An act to amend the education law, in relation to cred- iting of student progress in licensed trade or registered business schools SUMMARY OF SPECIFIC PROVISIONS: This bill is an amendment to Chapter 457 of 2003, to allow any licensed trade or registered business school that is accredited by an accrediting agency recognized by the U.S. Department of Education may, for participation in the Tuition Assistance Program and which has received national accreditation may, for the purpose of calculation of federal financial aid only, measure students' academic progress in non-degree granting credit hours. The prior chapter allowed only not-for-profit business schools to be eligible. JUSTIFICATION: Because the New York State Education Department measures academic progress for students who attend licensed trade or registered business schools in clock hours as opposed to credit hours, some students have found themselves receiving less federal financial aid than similarly situated students in other states. This bill would permit these schools to measure the academic progress of their students in non-degree granting credit hours for the sole purpose of receipt of federal financial aid, thus allowing students to qualify for more aid, receive the aid faster and retain more aid should they be forced to withdraw from school.

JACOBS -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, in relation to crediting of student progress in licensed trade or registered business schools THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph f of subdivision 4 of section 5002 of the educa- tion law, as added by chapter 457 of the laws of 2003, is amended to read as follows: f. Notwithstanding any other provision of [the] law, a [not-for-pro- fit] LICENSED TRADE OR registered business school, [that is eligible for participation in the tuition assistance program and which has national accreditation] ACCREDITED BY AN ACCREDITING AGENCY RECOGNIZED BY THE UNITED STATES DEPARTMENT OF EDUCATION, may[, for the purpose of calcu- lation of federal financial aid amounts only,] measure students' academ- ic progress in an approved curriculum in non-degree granting credit hours, based upon [a national] SUCH accrediting agency's conversion and approval of clock hours to non-degree GRANTING credit hours. [For the purposes of this paragraph, "national accreditation" shall mean accredi- tation by a national accrediting agency as defined in the commissioner's regulations.] THE SCHOOLS' CATALOG AND ENROLLMENT AGREEMENT SHALL STATE THAT THE NON-DEGREE GRANTING CREDIT HOURS DO NOT LEAD TO ANY DEGREE AND ARE NOT EQUIVALENT TO A CREDIT HOUR OFFERED AT A DEGREE GRANTING INSTI- TUTION. THE SCHOOLS' CATALOG WILL LIST THE LENGTH OF EACH COURSE IN BOTH CLOCK HOURS AND THE CORRESPONDING AMOUNT OF NON-DEGREE GRANTING CREDIT HOURS. S 2. This act shall take effect immediately.
