AN  ACT  to  amend  the  public health law, in relation to directing the
  department of health to annually publish a list of health care provid-
  ers who have five or more malpractice judgments, awards and/or settle-
  ments within the most recent ten years

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  2995-a  of  the  public health law is amended by
adding a new subdivision 1-a to read as follows:
  1-A. IN ADDITION TO  THE  REQUIREMENTS  OF  SUBDIVISION  ONE  OF  THIS
SECTION,  THE  DEPARTMENT SHALL ESTABLISH A LIST, IN A FORMAT THAT SHALL
BE AVAILABLE FOR DISSEMINATION TO THE PUBLIC, OF  LICENSEES  SUBJECT  TO
THE  AUTHORITY  OF  THE OFFICE OF PROFESSIONAL MEDICAL CONDUCT, WHO HAVE
FIVE OR MORE MEDICAL MALPRACTICE JUDGMENTS,  AWARDS  AND/OR  SETTLEMENTS
WITHIN  THE  MOST  RECENT  TEN  YEARS  IN WHICH PAYMENT WAS AWARDED TO A
COMPLAINING PARTY. SUCH LIST SHALL BE ANNUALLY PUBLISHED  ON  OR  BEFORE
JANUARY FIRST.
  S 2. This act shall take effect immediately.
