AN ACT to amend the public health  law,  in  relation  to  enacting  the
  "medical consumer 'right to know' act"

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Short title. This act shall be known and may  be  cited  as
the "medical consumer 'right to know' act".
  S  2.  Section  2995-a of the public health law is amended by adding a
new subdivision 1-b to read as follows:
  1-B. IN ADDITION TO  THE  REQUIREMENTS  OF  SUBDIVISION  ONE  OF  THIS
SECTION,  THE  DEPARTMENT SHALL ESTABLISH A LIST, IN A FORMAT THAT SHALL
BE AVAILABLE FOR DISSEMINATION TO THE PUBLIC, OF  LICENSEES  SUBJECT  TO
THE  AUTHORITY  OF  THE OFFICE OF PROFESSIONAL MEDICAL CONDUCT, WHO HAVE
FIVE OR MORE MEDICAL MALPRACTICE JUDGMENTS,  AWARDS  AND/OR  SETTLEMENTS
WITHIN  THE  MOST  RECENT  TEN  YEARS  IN WHICH PAYMENT WAS AWARDED TO A
COMPLAINING PARTY. SUCH LIST SHALL BE ANNUALLY PUBLISHED  ON  OR  BEFORE
JANUARY FIRST.
  S 3. This act shall take effect immediately.
