2009-A5563 (ACTIVE) - Summary

Requires that, in every school district in cities having a population of 1,000,000 or more, there shall be employed in every elementary school with non-English speaking pupils, at least one teacher who is licensed as a teacher of English as a secondary language for every fifty non-English speaking pupils or fraction thereof.

AN  ACT  to amend the education law, in relation to educational programs
  for certain non-English speaking pupils in a city having a  population
  of one million or more

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1.  Section 3204 of the education law is amended  by adding  a
new subdivision 6 to read as follows:
  6.    NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, IN A
SCHOOL DISTRICT IN A CITY HAVING A POPULATION OF ONE  MILLION  OR  MORE,
THERE  SHALL  BE  EMPLOYED  IN  EVERY ELEMENTARY SCHOOL WITH NON-ENGLISH
SPEAKING PUPILS AT LEAST ONE TEACHER WHO IS LICENSED  AS  A  TEACHER  OF
ENGLISH AS A SECOND LANGUAGE FOR EVERY FIFTY NON-ENGLISH SPEAKING PUPILS
OR  FRACTION  THEREOF,  IN ACCORDANCE WITH REGULATIONS PRESCRIBED BY THE
COMMISSIONER CONSISTENT WITH THIS SUBDIVISION.
  S 2. This act shall take effect on the one hundred twentieth day after
it shall have become a law. Effective immediately, the addition,  amend-
ment  and/or repeal of any rules or regulations necessary for the imple-
mentation of this act on its effective date are authorized to be made on
or before such effective date.
