2009-S4585 (ACTIVE) - Summary
Requires that, in every school district in cities having a population of 1,000,000 or more, there shall be employed in every elementary school with non-English speaking pupils, at least one teacher who is licensed as a teacher of English as a secondary language for every fifty non-English speaking pupils or fraction thereof.

BILL NUMBER: S4585 TITLE OF BILL : An act to amend the education law, in relation to educational programs for certain non-English speaking pupils in a city having a population of one million or more PURPOSE OR GENERAL IDEA OF BILL : In elementary schools, the English as a Second Language (ESL) program has been virtually wiped out despite the fact that there still exists a need to stress the teaching of English to non-English speaking pupils. SUMMARY OF PROVISIONS : This bill amends section 3204 of the education law by adding a new subdivision 6, which provides that there shall be employed in each elementary school in New York city one English as a second Language-licensed teacher for every fifty non-English speaking pupils or major fraction thereof. SERRANO -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to educational programs for certain non-English speaking pupils in a city having a population of one million or more THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3204 of the education law is amended by adding a new subdivision 6 to read as follows: 6. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, IN A SCHOOL DISTRICT IN A CITY HAVING A POPULATION OF ONE MILLION OR MORE, THERE SHALL BE EMPLOYED IN EVERY ELEMENTARY SCHOOL WITH NON-ENGLISH SPEAKING PUPILS AT LEAST ONE TEACHER WHO IS LICENSED AS A TEACHER OF ENGLISH AS A SECOND LANGUAGE FOR EVERY FIFTY NON-ENGLISH SPEAKING PUPILS OR FRACTION THEREOF, IN ACCORDANCE WITH REGULATIONS PRESCRIBED BY THE COMMISSIONER CONSISTENT WITH THIS SUBDIVISION. S 2. This act shall take effect on the one hundred twentieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rules or regulations necessary for the imple- mentation of this act on its effective date are authorized to be made on or before such effective date.
