AN ACT to amend the public authorities law, in relation to requiring the
  New  York state energy research and development authority to submit an
  annual report detailing energy efficiency savings  achieved  in  grant
  recipients' properties

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The public authorities law  is  amended  by  adding  a  new
section 1873 to read as follows:
  S  1873.  EXAMINATION AND REPORTING OF ENERGY EFFICIENCY GRANT RECIPI-
ENTS; REQUIRED. 1. THE AUTHORITY SHALL INVESTIGATE THE EFFECTIVENESS  OF
ALL  ENERGY  EFFICIENCY  GRANTS  AWARDED  TO  PROPERTIES IN THE STATE TO
DETERMINE  THE  ENERGY  SAVINGS  GAINED  THROUGH  UPGRADES  AND  REPAIRS
PERFORMED  WITH  GRANT  FUNDS.  THE AUTHORITY SHALL PROCURE ENERGY BILLS
FROM PROPERTIES IN RECEIPT OF GRANT FUNDING THROUGH THE  UTILITY  CORPO-
RATION THAT SERVES AS THE ENERGY PROVIDER ONE YEAR PRIOR TO THE UPGRADES
AND  REPAIRS EXECUTED WITH GRANT FUNDING AND FOR TWO YEARS SUBSEQUENT TO
THE PHYSICAL ENHANCEMENTS OF SUCH PROPERTY.  THE  AUTHORITY  SHALL  THEN
ANALYZE THIS DATA TO DETERMINE THE ENERGY SAVINGS GAINED THROUGH CAPITAL
IMPROVEMENTS  ACCOMPLISHED  WITH  GRANT  FUNDING.  THIS  ANALYSIS SHOULD
ACCOUNT FOR MARKET RATE FLUCTUATIONS AND OTHER SUCH OUTSIDE FACTORS  NOT
DIRECTLY  RELATED  TO  CAPITAL  UPGRADES  DESIGNED  TO  ENCOURAGE ENERGY
SAVINGS. THIS DATA SHALL BE RECORDED IN AN ANNUAL REPORT  IN  ACCORDANCE
WITH SUBDIVISION TWO OF THIS SECTION.
  2.  THE  AUTHORITY  SHALL FILE WITH THE LEGISLATURE, THE EXECUTIVE AND
THE CHAIRMAN OF THE STATE ENERGY PLANNING BOARD AN ANNUAL REPORT DETAIL-
ING THE ANALYSIS OF ENERGY SAVINGS OF PROPERTIES IN RECEIPT OF AUTHORITY
GRANT FUNDING AND THE TOTAL ENERGY  SAVINGS  OF  SUCH  PROPERTIES.  SUCH
REPORT  SHALL  ALSO  BE  DELIVERED  DIRECTLY  TO THE CHAIR OF THE CORPO-
RATIONS, AUTHORITIES, AND COMMISSIONS COMMITTEE IN THE SENATE, THE CHAIR

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public  authorities  law  is amended by adding a new
section 1873 to read as follows:
  S 1873. EXAMINATION AND REPORTING OF ENERGY EFFICIENCY  GRANT  RECIPI-
ENTS; REQUIRED.  THE AUTHORITY SHALL SUBMIT TO THE GOVERNOR, THE SPEAKER
OF THE ASSEMBLY, THE TEMPORARY PRESIDENT OF THE SENATE, THE CHAIR OF THE
STATE ENERGY PLANNING BOARD, THE CHAIR OF THE ASSEMBLY ENERGY COMMITTEE,
THE  RANKING MINORITY MEMBER OF THE ASSEMBLY ENERGY COMMITTEE, THE CHAIR
OF THE SENATE  ENERGY  AND  TELECOMMUNICATIONS  COMMITTEE,  THE  RANKING
MINORITY  MEMBER  OF THE SENATE ENERGY AND TELECOMMUNICATIONS COMMITTEE,
THE CHAIR OF THE  ASSEMBLY  CORPORATIONS,  AUTHORITIES  AND  COMMISSIONS
COMMITTEE,  THE  RANKING  MINORITY  MEMBER OF THE ASSEMBLY CORPORATIONS,
AUTHORITIES AND COMMISSIONS COMMITTEE, THE CHAIR OF  THE  SENATE  CORPO-
RATIONS,  AUTHORITIES  AND  COMMISSIONS  COMMITTEE, THE RANKING MINORITY
MEMBER OF THE SENATE CORPORATIONS, AUTHORITIES AND COMMISSIONS COMMITTEE
AND THE CHAIR OF THE RENEWABLE ENERGY SUBCOMMITTEE  IN  THE  ASSEMBLY  A
COPY OF THE ANNUAL REPORT THE AUTHORITY IS REQUIRED TO PRODUCE TO COMPLY
WITH  THE  PUBLIC SERVICE COMMISSION ORDER ESTABLISHING THE ENERGY EFFI-
CIENCY PORTFOLIO STANDARD AND APPROVING PROGRAMS.
  S 2. This act shall take effect immediately.
