Provides that unremarried spouses of deceased employees of the state who retired prior to April 1, 1979 shall be required to pay for health insurance coverage at the same rate as paid by active employees of the state.

AN  ACT  to amend the civil service law, in relation to health insurance
  coverage for certain dependents of deceased state employees

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The three undesignated paragraphs of section 165-a of the
civil service law are designated subdivisions 1,  3  and  4  and  a  new
subdivision 2 is added to read as follows:
   2.  NOTWITHSTANDING ANY OTHER PROVISION OF LAW, AN UNREMARRIED SPOUSE
OF AN EMPLOYEE OF THE STATE WHO RETIRED PRIOR TO APRIL  FIRST,  NINETEEN
HUNDRED  SEVENTY-NINE  AND  DECEASED  SUBSEQUENT TO SUCH RETIREMENT, AND
SUCH SPOUSE HAVING BEEN DETERMINED TO BE ELIGIBLE FOR CONTINUED COVERAGE
AS A DEPENDENT SURVIVOR AND HAVING TIMELY ELECTED TO CONTINUE  DEPENDENT
COVERAGE,  SHALL BE REQUIRED TO PAY FOR HEALTH INSURANCE COVERAGE AT THE
SAME RATE AS IS PAID BY ACTIVE EMPLOYEES OF THE STATE.
  S 2. This act shall take effect on the ninetieth day  after  it  shall
have become a law.
