BILL NUMBER: S4974 TITLE OF BILL : An act to amend the civil service law, in relation to health insurance coverage for certain dependents of deceased state employees PURPOSE : The subject legislation adds a new subdivision 2 to Section 165-a of the Civil Service Law. Said paragraph provides that unremarried spouses of retirees who retired prior to April 1979, and subsequently passed away would pay the same amount for health insurance coverage as those employees who retired after April 1, 1979. SUMMARY & JUSTIFICATION : Currently, an unremarried spouse of a retiree who retired prior to April 1, 1979, and subsequently died, must pay the full cost of health insurance coverage. However, for a retiree who retired after April 1, 1979 and subsequently dies, his or her unremarried spouse must pay only a minimal amount for health insurance coverage. LEGISLATIVE HISTORY : S.4163 - vetoed 8/27/07. S.2136B/A.7525B of 2005-06; S.2636-A/A.6559-A of 2003-04. FISCAL IMPLICATIONS : Based on the actual number of pre-1979 survivors now enrolled, the cost to the State is $6,710,154. EFFECTIVE DATE : Ninetieth day after it shall become a law.

CARROZZA -- read once and referred to the Committee on Governmental Employees AN ACT to amend the civil service law, in relation to health insurance coverage for certain dependents of deceased state employees THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The three undesignated paragraphs of section 165-a of the civil service law are designated subdivisions 1, 3 and 4 and a new subdivision 2 is added to read as follows: 2. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, AN UNREMARRIED SPOUSE OF AN EMPLOYEE OF THE STATE WHO RETIRED PRIOR TO APRIL FIRST, NINETEEN HUNDRED SEVENTY-NINE AND DECEASED SUBSEQUENT TO SUCH RETIREMENT, AND SUCH SPOUSE HAVING BEEN DETERMINED TO BE ELIGIBLE FOR CONTINUED COVERAGE AS A DEPENDENT SURVIVOR AND HAVING TIMELY ELECTED TO CONTINUE DEPENDENT COVERAGE, SHALL BE REQUIRED TO PAY FOR HEALTH INSURANCE COVERAGE AT THE SAME RATE AS IS PAID BY ACTIVE EMPLOYEES OF THE STATE. S 2. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
