2009-A8527 (ACTIVE) - Summary

Provides that all ballots printed for use on a voting system approved by the state board of elections may be printed and arranged in a manner which would permit them to be counted by such machine; ensures ballots can be configured in a manner that will allow scanners to sufficiently and adequately discern votes cast by voters and eliminates outdated ballot layout provisions.

AN ACT to amend the election law,  in  relation  to  ballots  which  are
  counted  by  machine;  to amend the election law, in relation to paper
  ballots; and to repeal section 8-310 of such law,  relating  to  paper
  ballots

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 7-121 of the election law, as added by chapter  352
of the laws of 1986, is amended to read as follows:
  S  7-121.  Ballots which are counted by machine. [A board of elections
may provide, by  resolution  adopted  at  least  two  months  before  an
election  at  which  voting machines are used, that all ballots cast for
such election, other than on the voting machines, shall be counted by  a
machine  of  a  type]  ALL  BALLOTS  PRINTED  FOR USE ON A VOTING SYSTEM
approved by the state board of elections [and that all  ballots  printed
for  use at such election] may be printed and arranged in a manner which
would permit them to be counted by such machine.
  S 2. Section 8-310 of the election law is REPEALED.
  S 3. The section heading of section  8-312  of  the  election  law  is
amended and a new subdivision 6 is added to read as follows:
  Voting; paper ballots, marking and casting, DELIVERY TO VOTER.
  6.  PAPER  BALLOTS  BEING  USED  WITH  OPTICAL  SCAN VOTING SYSTEMS OR
INTENDED TO BE COUNTED BY HAND PURSUANT TO SUBDIVISION  ONE  OF  SECTION
7-200  OF  THIS  CHAPTER  SHALL  BE  DELIVERED  TO THE VOTER IN A MANNER
CONSISTENT WITH THE RULES AND REGULATIONS PROMULGATED BY THE STATE BOARD
OF ELECTIONS.
  S 4. This act shall take effect immediately.
