AN ACT to amend chapter 53 of the laws of 2009, enacting the  education,
  labor and family assistance budget, in relation to charter schools

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 1 of chapter 53 of the laws of 2009,  enacting  the
education,  labor  and family assistance budget, is amended by repealing
the items herein below set forth in  brackets  and  by  adding  to  such
section the other items underscored in this section.

  General Fund / Aid to Localities
  Local Assistance Account - 001

For  services  and  expenses  related to the
  development, implementation and  operation
  of  charter schools for the 2009-10 school
  year including $1,981,000 for  administra-
  tive/technical  support  services provided
  by the charter  school  institute  of  the
  state  university  of  New  York AND UP TO
  $1,000,000  FOR  THE  ESTABLISHMENT  OF  A
  PER-PUPIL FACILITIES AID PROGRAM FOR CHAR-
  TER  SCHOOLS  THAT IS REQUIRED FOR FEDERAL
  GRANT  ELIGIBILITY.    This  appropriation
  shall  only  be  available for expenditure
  upon the approval of an  expenditure  plan
  by  the  director  of the budget and funds
  appropriated herein shall  be  transferred
  to  the miscellaneous special revenue fund
  - charter schools stimulus account ........... 5,528,000
