BILL NUMBER:A9843 TITLE OF BILL: An act to amend the military law, in relation to active service PURPOSE OF THE BILL: This bill would allow individuals serving in the military to be considered actively serving when they are away from their residence and undergoing training. SUMMARY OF PROVISIONS: Section 1 of this bill amends subdivision 6 of section 1 of the military law in terms of the definition of "active service." This legislation adds to the definition by including service as a member of a national guard or as a reservist absent from his or her place of residence and undergoing training under the direction of the army, air force, navy, marine corps or coast guard, at a place other than that of such person's residence. JUSTIFICATION: Often, individuals serving some military duty have to move out of their state of residency while they are in training. Usual- ly, these people lose their state residency and must relocate to where they are training, which can sometimes be burdensome to the individual and/or family of the individual. This legislation will include the 6 months of training into the definition of "active service" so that they can count this as time served in the military. PRIOR LEGISLATIVE HISTORY: New Bill.

HYER-SPENCER -- read once and referred to the Committee on Veterans' Affairs AN ACT to amend the military law, in relation to active service THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 6 of section 1 of the military law, as amended by chapter 112 of the laws of 1989, is amended to read as follows: 6. The terms "active service" and "active duty" shall mean military duty in or with a force of the organized militia (not including the inactive national guard and not including the New York guard when in an inactive status) or in the division of military and naval affairs of the executive department of the state, either in a full time status or in a part-time status, depending upon the conditions under which the duty is performed AND SHALL INCLUDE SERVICE AS A MEMBER OF THE NATIONAL GUARD OR AS A RESERVIST ABSENT FROM HIS OR HER PLACE OF RESIDENCE AND UNDERGOING TRAINING UNDER THE DIRECTION OF THE ARMY, AIR FORCE, NAVY, MARINE CORPS OR COAST GUARD, AT A PLACE OTHER THAN THAT OF SUCH PERSON'S RESIDENCE.
