BOYLAND, BURLING, COLTON, DESTITO, FINCH, GOTTFRIED, HOOP- ER, KOLB, LUPARDO, McDONOUGH, MONTESANO, PHEFFER, RAIA, SALADINO, TOBACCO, WEISENBERG -- read once and referred to the Committee on Veterans' Affairs AN ACT to amend the military law, in relation to active service THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 6 of section 1 of the military law, as amended by chapter 112 of the laws of 1989, is amended to read as follows: 6. The terms "active service" and "active duty" shall mean military duty in or with a force of the organized militia (not including the inactive national guard and not including the New York guard when in an inactive status) or in the division of military and naval affairs of the executive department of the state, either in a full time status or in a part-time status, depending upon the conditions under which the duty is performed AND SHALL INCLUDE SERVICE AS A MEMBER OF THE NATIONAL GUARD OR AS A RESERVIST ABSENT FROM HIS OR HER PLACE OF RESIDENCE AND UNDERGOING TRAINING UNDER THE DIRECTION OF THE ARMY, AIR FORCE, NAVY, MARINE CORPS OR COAST GUARD, AT A PLACE OTHER THAN THAT OF SUCH PERSON'S RESIDENCE.
