BILL NUMBER: S142 TITLE OF BILL : An act to amend the executive law, in relation to authorizing the division of criminal justice services to release criminal history record information to certain persons employed by the administration for children's services in the city of New York PURPOSE : Provides that criminal history records held by the division of criminal justice services may be released to child abuse caseworkers in New York City. SUMMARY OF PROVISIONS : Section one. Section 837 of the executive law is amended by adding a new subdivision 19 to supply upon request criminal history information of adults living in households involved in a child abuse allegations in City of New York, to caseworkers employed by the Administration of Children's Services in the City of New York. JUSTIFICATION : This legislation would allow New York City ACS (Administration for Children's Services) caseworkers to check and compare criminal records of adults in households where credible child abuse allegations have been reported. SAMPSON -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to authorizing the divi- sion of criminal justice services to release criminal history record information to certain persons employed by the administration for children's services in the city of New York THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 837 of the executive law is amended by adding a new subdivision 19 to read as follows: 19. NOTWITHSTANDING ANY OTHER LAW, RULE OR REGULATION TO THE CONTRARY, SUPPLY UPON REQUEST, AND IN ACCORDANCE WITH RULES AND REGULATIONS TO BE PROMULGATED BY THE COMMISSIONER, CRIMINAL HISTORY RECORD INFORMATION OF ADULTS LIVING IN HOUSEHOLDS INVOLVED IN A CHILD ABUSE ALLEGATION IN THE CITY OF NEW YORK, TO CASEWORKERS EMPLOYED BY THE ADMINISTRATION FOR CHILDREN'S SERVICES IN THE CITY OF NEW YORK. S 2. This act shall take effect on the ninetieth day after it shall have become a law; provided that the commissioner of the division of criminal justice services is immediately authorized and directed to promulgate, amend and/or repeal any rules and regulations necessary to implement the provisions of this act on its effective date.
