BILL NUMBER: S3622 TITLE OF BILL : An act relating to authorizing the canal corporation to abandon canal terminal lands in the Syracuse inner harbor PURPOSE OF THE BILL : This bill would authorize the Canal Corporation to sell, conveyor otherwise dispose of property at the old canal terminal site in the Syracuse Inner Harbor. SUMMARY OF PROVISIONS : Section 1 of this bill would authorize the Canal Corporation to abandon and dispose of barge canal terminal lands in the Syracuse Inner Harbor upon the approval of the Director of the Budget. Section 2 of this bill would take effect immediately. EXISTING LAW : Canal Law § 50 prohibits the Canal Corporation from abandoning canal barge terminal properties absent a prior special act of the

DILAN -- (at request of the Thruway Authority) -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT relating to authorizing the canal corporation to abandon canal terminal lands in the Syracuse inner harbor THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. In accordance with section 50 of the canal law, it is here- by found and determined that the present barge canal terminal located in the city of Syracuse, Onondaga county, and all of its barge canal termi- nal lands, consisting of approximately 3.85 acres located on the north- ern, eastern and southern shore of the Syracuse inner harbor, including two piers within the vicinity of Kirkpatrick Street and Solar Street, are no longer necessary or useful as part of the barge canal system, as an aid to navigation thereon, or for barge canal terminal purposes. The New York state canal corporation is authorized to sell, convey or other- wise dispose of any part of or all the right, title and interest to such property, upon the approval of the director of the budget. Notwith- standing the foregoing, any sale, conveyance or disposal of the barge canal terminal or terminal lands shall be structured in a manner that maintains public access to existing local waterfront revitalization facilities, including the amphitheater and north pier, constructed with state funds under title 11 of article 54 of the environmental conserva- tion law (Environmental Protection Act).
