BILL NUMBER: S4265 TITLE OF BILL : An act to amend the public officers law, in relation to post-employment restrictions PURPOSE OF THE BILL : To amend Public Officers Law § 73(8-b) to enable State agencies to hire former employees currently under contract or subcontract with the federal government, without violating the post employment restrictions. SUMMARY OF PROVISIONS : Section one amends Public Officers Law § 73(8-b) to allow a former State employee under contract or subcontract to the federal government to render services for any State agency, provided the agency head certifies to the Commission on Public Integrity ("Commission") that such individual has the expertise, knowledge or experience with regard to a particular matter that meets the needs of the agency and cannot be obtained at comparable cost. Section two provides for an immediate effective date.

KRUGER -- (at request of the State Commission on Public Integrity) -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the public officers law, in relation to post-employment restrictions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 8-b of section 73 of the public officers law, as added by chapter 523 of the laws of 2004, is amended to read as follows: 8-b. Notwithstanding the provisions of subparagraphs (i) and (ii) of paragraph (a) of subdivision eight of this section, a former state offi- cer or employee may contract individually, or as a member or employee of a firm, corporation [or], association, OR CONTRACTOR OR SUBCONTRACTOR TO THE FEDERAL GOVERNMENT to render services to any state agency if, prior to engaging in such service, the agency head certifies in writing to the [state ethics] commission ON PUBLIC INTEGRITY that such former officer or employee has expertise, knowledge or experience with respect to a particular matter which meets the needs of the agency and is otherwise unavailable at a comparable cost. Where approval of the contract is required under section one hundred twelve of the state finance law, the comptroller shall review and consider the reasons for such certif- ication. The [state ethics] commission ON PUBLIC INTEGRITY must review and approve all certifications made pursuant to this subdivision. S 2. This act shall take effect immediately.
